{"id":317584,"date":"2024-11-27T18:54:35","date_gmt":"2024-11-27T13:24:35","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=317584"},"modified":"2024-11-27T21:09:58","modified_gmt":"2024-11-27T15:39:58","slug":"sc-rejects-ballot-paper-plea","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/sc-rejects-ballot-paper-plea\/","title":{"rendered":"SC rejects ballot paper plea"},"content":{"rendered":"<p><strong>News<\/strong>: The Supreme Court dismissed a Public Interest Litigation (PIL) that called for the reinstatement of ballot papers instead of Electronic Voting Machines (EVMs).<\/p>\n<h2>About Electronic Voting Machine (EVM)<\/h2>\n<p><strong>1.<\/strong> It is a device used to electronically record, and count votes cast in elections.<\/p>\n<p><strong>2.<\/strong> They were first used in the Paravur Assembly Constituency of Kerala in the year 1982.<\/p>\n<p><strong>3.<\/strong> It is manufactured and supplied to the Election Commission of India (ECI) by <em><strong>Bharat Electronics Limited<\/strong><\/em> (under the Ministry of Defense) and <em><strong>Electronic Corporation of India Limited<\/strong><\/em> (under the Department of Atomic Energy).<\/p>\n<p><strong>4.<\/strong> <em><strong>EVM consists of three units<\/strong><\/em>:<\/p>\n<figure id=\"attachment_317585\" aria-describedby=\"caption-attachment-317585\" style=\"width: 390px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\" wp-image-317585\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/11\/EVM.png?resize=390%2C245&#038;ssl=1\" alt=\"EVM\" width=\"390\" height=\"245\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/11\/EVM.png?w=698&amp;ssl=1 698w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2024\/11\/EVM.png?resize=300%2C189&amp;ssl=1 300w\" sizes=\"auto, (max-width: 390px) 100vw, 390px\" \/><figcaption id=\"caption-attachment-317585\" class=\"wp-caption-text\">Source-Researchgate<\/figcaption><\/figure>\n<ul>\n<li><strong>Ballot Unit<\/strong>&#8211; Functions like a keyboard using which the voters cast their votes.<\/li>\n<li><strong>Control Unit<\/strong>&#8211; It controls the operations of the Ballot Units and manages the data. It remains with the Presiding Officer or a Polling Officer.<\/li>\n<li><strong>Voter Verifiable Paper Audit Trail (VVPAT)<\/strong> &#8211; Allow the voters to verify that their votes are cast as intended. When a vote is cast, a slip is printed <strong><em>containing the serial number<\/em><\/strong>, <em><strong>name<\/strong><\/em> and <em><strong>symbol of the candidate<\/strong><\/em> and remains exposed through a transparent window for 7 seconds.<\/li>\n<\/ul>\n<p><strong>Note<\/strong>&#8211; Presently, the <em><strong>M3 Model<\/strong><\/em> of ECI-EVM and VVPAT are used.<\/p>\n<h2>Mechanism for verification of EVM Burnt Memory<\/h2>\n<p>In April 2024, the Supreme Court allowed losing candidates to request verification of the burnt memory in EVMs and VVPAT machines.<\/p>\n<p><strong>1.<\/strong> Candidates <em><strong>finishing 2nd<\/strong><\/em> or <em><strong>3rd can request verification of the microcontroller memory in 5% of EVMs<\/strong><\/em>, including the control unit, ballot unit, and VVPAT per Assembly segment or Lok Sabha segment to check for tampering.<\/p>\n<p><strong>2.<\/strong> Candidates must identify the EVMs to be verified by polling station or serial number and can be present during the process.<\/p>\n<p><strong>3.<\/strong> Requests for verification <em><strong>must be submitted within 7 days of the result declaration<\/strong><\/em>.<\/p>\n<p><strong>4. <em>Candidates bear the verification cost<\/em><\/strong>, but expenses are refunded if tampering is found.<\/p>\n<p><strong>Verification Process:<\/strong><\/p>\n<p><strong>1.<\/strong> The District Electoral Officer (DEO) oversees the verification.<\/p>\n<p><strong>2.<\/strong> Candidates can select units to be verified by polling station number or serial number of the EVM components like Ballot Unit, Control Unit, and VVPAT.<\/p>\n<p><strong>3.<\/strong> A written request must be submitted to the DEO.<\/p>\n<p><strong>4.<\/strong> DEOs send the list of requests to the State Chief Electoral Officer, who informs the EVM manufacturers (BEL and ECIL) within 30 days of the result declaration.<\/p>\n<p><strong>5.<\/strong> Verification will begin after the <em><strong>45-day period<\/strong><\/em> following the declaration of results,<em><strong> during which Election Petitions can be filed.<\/strong><\/em><\/p>\n<p><strong>6.<\/strong> If no petitions are filed, the checking process will proceed.
