{"id":31860,"date":"2018-10-29T11:34:09","date_gmt":"2018-10-29T06:04:09","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=31860"},"modified":"2018-10-29T11:34:09","modified_gmt":"2018-10-29T06:04:09","slug":"profit-and-loss","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/profit-and-loss\/","title":{"rendered":"Profit and loss"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/editorial\/profit-and-loss\/article22486454.ece\"><b>Profit and loss <\/b><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The disqualification of AAP MLAs for holding office of profit<\/span><\/li>\n<\/ul>\n<p><b>AAP\u2019s stand:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The party claims it was denied a hearing and alleges political motives behind the action.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It has questioned the timing of the decision, just ahead of the Chief Election Commissioner\u2019s retirement.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Regardless of the charge of political malice, the correctness of the EC\u2019s decision will be decided on legal grounds.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The courts will have to rule on the question whether the post of parliamentary secretary, which these MLAs were holding, is an \u2018office of profit\u2019.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They may also examine whether there was any violation of natural justice.<\/span><\/li>\n<\/ul>\n<p><b>Issues involved:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The key question was whether the post was an office of profit even after the Delhi government made it clear that parliamentary secretaries would not be eligible for any remuneration or perquisites.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">They were only allowed the use of government transport for official uses and office space in the respective ministries.<\/span><\/li>\n<\/ul>\n<p><b>Office of Profit:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">An office of profit is a term used in a number of national constitutions to refer to executive appointments.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">If an MLA or an MP holds a government office and receives benefits from it, then that office is termed as an \u201coffice of profit\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A person will be disqualified if he holds an office of profit under the central or state government, other than an office declared not to disqualify its holder by a law passed by Parliament or state legislature.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A number of countries forbid members of the legislature from accepting an office of profit under the executive as a means to secure the independence of the legislature and preserve separation of powers.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The word \u2018office\u2019 has not been defined in the Indian Constitution or the <\/span><b>Representation of the People Act of 1951. <\/b><span style=\"font-weight: 400;\">But different courts have interpreted it to mean a position with certain duties that are more or less of public character.<\/span><\/li>\n<\/ul>\n<p><strong>Examples:<\/strong><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In <\/span><i><span style=\"font-weight: 400;\">Jaya Bachchan<\/span><\/i><span style=\"font-weight: 400;\">, the court said it was an office of profit even if one did not actually receive payment; it was enough if some pay was \u2018receivable\u2019.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In <\/span><i><span style=\"font-weight: 400;\">Raman v. P.T.A.
