{"id":32318,"date":"2018-10-29T13:35:20","date_gmt":"2018-10-29T08:05:20","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=32318"},"modified":"2018-10-29T13:35:20","modified_gmt":"2018-10-29T08:05:20","slug":"key-ministries-disagree-over-campa-fund-rules","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/key-ministries-disagree-over-campa-fund-rules\/","title":{"rendered":"Key ministries disagree over CAMPA fund rules\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/news\/national\/key-ministries-disagree-over-campa-fund\/article22360616.ece\"><strong>Key ministries disagree over CAMPA fund rules<\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p><strong>Context<\/strong><\/p>\n<p>Differences between the environment ministry and the finance ministry have become a roadblock to the Compensatory Afforestation Fund Management and Planning Authority (CAMPA).<\/p>\n<p><strong>CAMPA<\/strong><\/p>\n<ul>\n<li>This authority was envisaged as an independent body that would manage a corpus \u2014 collected from industries that have used forest land for projects \u2014 that accumulates around \u20b96,000 crore annually and is already worth around Rs 42,000 crore<\/li>\n<li>These funds are meant to be used by states to implement agro-forestry in non-forest land to compensate for felled forest.<\/li>\n<\/ul>\n<p><strong>Hasn\u2019t come into existence yet<\/strong><\/p>\n<ul>\n<li>In spite of Parliament \u2014 after a fractious debate \u2014 signing CAMPA into law last year, it is yet to come into existence.<\/li>\n<li>Minister of State for Environment told Parliament last week that this was because the \u201crules\u201d governing the management of the fund weren\u2019t finalised and several meetings had been held among states to fix these rules.<\/li>\n<\/ul>\n<p><strong>Finance Ministry: funds should be routed through CFI<\/strong><\/p>\n<p>Power to disburse the funds should be with the CAMPA, however the finance ministry says it should be routed through the Consolidated Fund of India (CFI)<\/p>\n<p><strong>Not ideal<\/strong><\/p>\n<p>That\u2019s not ideal as it could allow states to use it for purposes other than afforestation<\/p>\n<p><strong>Parliamentary approval<\/strong><\/p>\n<ul>\n<li>The CFI is the repository of government revenues and taxes and all funds channelled through it require Parliamentary approval<\/li>\n<li>Currently funds collected under CAMPA directly go into the Public Account and from thereon to the states<\/li>\n<\/ul>\n<p><strong>Example<\/strong><\/p>\n<p>By way of example, the education cess that the government collects never necessarily gets spent on education The Comptroller and Auditor General recently pulled up the government for not transferring \u20b983,497 crore, collected as a \u2018Secondary and Higher Education Cess\u2019 in the Consolidated Fund of India during 2006-2007 to 2016-2017, to designated funds in the Public Account from where government routes money to schemes.<\/p>\n<p><strong>Ad hoc mechanism currently<\/strong><\/p>\n<p>Currently, states are able to access CAMPA funds through an \u201cad hoc\u201d mechanism whereby the Centre disburses it on a needs-basis<\/p>\n<p><strong>Not enough due diligence<\/strong><\/p>\n<ul>\n<li>There are, however, too few personnel entrusted with managing this fund and often there isn\u2019t enough due-diligence done to ensure that states are given money for purposes specific to regenerating forest<\/li>\n<li>This year, for instance, the ad hoc body disbursed only \u20b91,827 crore to states this year as opposed to \u20b92,213 crore and \u20b92,057 crore in the preceding years.<\/li>\n<\/ul>\n<p><strong>SC order<\/strong><\/p>\n<p>The Supreme Court, in a 2009 order, had directed that an independent authority be charged with disbursing these funds, which paved the way for the Compensatory and Afforestation Fund (CAF) Bill envisaging the creation of a permanent Compensatory Afforestation Fund Management and Planning Authority<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Last July, the Rajya Sabha signed into law the CAMPA Bill that allows the states to access nearly \u20b942,000 crore \u2014 mostly collected from industrial projects as penalties \u2014 from CAMPA and channel it into afforestation projects.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Key ministries disagree over CAMPA fund rules\u00a0 Context Differences between the environment ministry and the finance ministry have become a roadblock to the Compensatory Afforestation Fund Management and Planning Authority (CAMPA).
