{"id":324462,"date":"2025-01-24T11:06:19","date_gmt":"2025-01-24T05:36:19","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=324462"},"modified":"2025-01-24T11:06:19","modified_gmt":"2025-01-24T05:36:19","slug":"ad-hoc-judges-in-high-court","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/ad-hoc-judges-in-high-court\/","title":{"rendered":"Ad-hoc Judges in High Court"},"content":{"rendered":"<p><strong>News: <\/strong>The Supreme Court recently suggested the temporary appointment of retired High Court judges on an ad hoc (as-needed) basis to address the backlog of pending criminal cases in several High Courts.<\/p>\n<h2>About Ad-hoc Judges in High Court<\/h2>\n<p><strong>Constitutional Provisions<\/strong>&#8211; The appointment of ad hoc judges is provided for in the Constitution under <strong>Article 224A<\/strong> (Appointment of Retired Judges at Sittings of High Courts).<\/p>\n<p>Under this Article:<\/p>\n<ul>\n<li>The <em>Chief Justice of a High Court<\/em> for any State may request a person to act as a judge of the High Court.<\/li>\n<li>The <em>prior consent of the President<\/em> is required for such an appointment.<\/li>\n<li>The individual must have previously held the office of a judge in that High Court or any other High Court.<\/li>\n<li>Such a judge is <em>entitled to allowances as determined by the President.<\/em><\/li>\n<li>They will also enjoy all the jurisdiction, powers, and privileges of a sitting judge of that High Court.<\/li>\n<li>This article does not require any such person to serve as a judge of the High Court unless they agree to do so.<\/li>\n<\/ul>\n<p><strong>Supreme Court guidelines for the Appointment of Ad hoc Judges<\/strong><\/p>\n<div class=\"flex max-w-full flex-col flex-grow\">\n<div class=\"min-h-8 text-message flex w-full flex-col items-end gap-2 whitespace-normal break-words text-start [.text-message+&amp;]:mt-5\" dir=\"auto\" data-message-author-role=\"assistant\" data-message-id=\"659634a6-9b09-4d83-a0af-594956a7158f\" data-message-model-slug=\"gpt-4o\">\n<div class=\"flex w-full flex-col gap-1 empty:hidden first:pt-[3px]\">\n<div class=\"markdown prose w-full break-words dark:prose-invert light\">\n<ul>\n<li>If a High Court has more than <em>20% of its sanctioned positions vacant<\/em>;<\/li>\n<li>If cases in a specific category have been <em>pending for over five years<\/em>;<\/li>\n<li>If more than 10% of the High Court&#8217;s total cases have been pending for over five years;<\/li>\n<li>If the rate of case disposal is consistently lower than the rate of case filing (referred to as the &#8216;case clearance rate&#8217;).<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"mb-2 flex gap-3 empty:hidden -ml-2\">\n<div class=\"items-center justify-start rounded-xl p-1 flex\"><\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>News: The Supreme Court recently suggested the temporary appointment of retired High Court judges on an ad hoc (as-needed) basis to address the backlog of pending criminal cases in several High Courts.
