{"id":32501,"date":"2018-10-29T15:06:33","date_gmt":"2018-10-29T09:36:33","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=32501"},"modified":"2018-11-17T17:02:56","modified_gmt":"2018-11-17T11:32:56","slug":"tribunal-to-try-benami-cases-soon","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/tribunal-to-try-benami-cases-soon\/","title":{"rendered":"Tribunal to try benami cases soon"},"content":{"rendered":"<p><a style=\"font-size: 1.5rem;\" href=\"https:\/\/www.thehindu.com\/todays-paper\/tp-national\/tribunal-to-try-benami-cases\/article25316307.ece\">Tribunal to try benami cases soon<\/a><\/p>\n<p><strong>News:<\/strong><\/p>\n<ol>\n<li>The government has approved the appointment of Adjudicating Authority and establishment of Appellate Tribunal for speedy disposal of cases related to benami transactions.<\/li>\n<\/ol>\n<p><strong>Important Facts:<\/strong><\/p>\n<ol start=\"2\">\n<li>The Adjudicating Authority and Appellate Tribunal has been created under Prohibition of Benami Property Transactions Act (PBPT), 1988.<\/li>\n<li><strong>Salient Features of Adjudicating Authority and Appellate Tribunal (AAAT): <\/strong><\/li>\n<\/ol>\n<ul>\n<li>Appointment of an Adjudicating Authority, along with the <strong>three additional Benches<\/strong> and to establish the Appellate Tribunal under the PBPT Act.<\/li>\n<li>To provide the officers and employees to Adjudicating Authority by <strong>diverting the existing posts <\/strong>at the same level\/rank from the Income Tax Deptt.\/Central Board of Direct Taxes (CBDT).<\/li>\n<li>The AAAT will be<strong> based in Delhi <\/strong>and benches of Adjudicating Authority may sit in Kolkata, Mumbai and Chennai, after making <strong>consultation with the Chairperson <\/strong>of the proposed Adjudicating Authority.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong>Background:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>The government had notified sessions courts in 34 States and Union Territories, which will act as special courts for trial of offences under the benami transaction law.<\/li>\n<\/ul>\n<ol start=\"5\">\n<li><strong>Significance:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Effective and better administration of cases referred to the Adjudicating Authority.<\/li>\n<li>Speedy disposal of appeals filed against the order of the Adjudicating Authority before the Appellate Tribunal.<\/li>\n<li>It would provide first stage review of administrative action under the PBPT Act.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li><strong> About Benami transaction:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>It refers to transactions made in a fictitious name, or the owner is not aware of the ownership of the property, or the person paying for the property is not traceable.<\/li>\n<li>The rules and all the provisions of the Benami Transactions (Prohibition) Act came into force on November 1, 2016.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Tribunal to try benami cases soon News: The government has approved the appointment of Adjudicating Authority and establishment of Appellate Tribunal for speedy disposal of cases related to benami transactions.
