{"id":32570,"date":"2018-10-29T15:22:39","date_gmt":"2018-10-29T09:52:39","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=32570"},"modified":"2018-11-20T15:23:25","modified_gmt":"2018-11-20T09:53:25","slug":"pocso-gets-a-shot-in-the-arm","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/pocso-gets-a-shot-in-the-arm\/","title":{"rendered":"POCSO gets a shot in the arm"},"content":{"rendered":"<p><a href=\"https:\/\/www.hindustantimes.com\/punjab\/no-bar-for-reporting-child-abuse-the-long-and-short-of-it\/story-UVvsr17tOOCXOreadLJSIL.html\"><b>POCSO gets a shot in the arm<\/b><\/a><\/p>\n<ol>\n<li><b> \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0News<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Union ministry of law and justice has ratified a proposal of women and child development ministry to remove the time limit and age limit for reporting cases of sexual abuse among children<\/span><\/p>\n<table>\n<tbody>\n<tr>\n<td><b>POCSO (The Protection of Children from Sexual Offences Act) Act 2012:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Act had come into force with effect from 14 November, 2012<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Act defines a child as any person below 18 years of age<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It defines different forms of sexual abuse, including penetrative and non-penetrative assault, as well as sexual harassment and pornography<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It deems a sexual assault to be \u201caggravated\u201d under certain circumstances, such as when the abused child is mentally ill or act committed by a person of trust or authority vis-\u00e0-vis the child, like a family member, police officer, teacher, or doctor.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Special Court taking cognizance of the matter should be able to complete trial within one year from the date of taking cognizance of abuse<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><b>Important Facts<\/b><\/p>\n<ol start=\"3\">\n<li><b> Need for amendment:<\/b><\/li>\n<\/ol>\n<ul>\n<li style=\"font-weight: 400;\"><b>Discrepancy in laws<\/b><span style=\"font-weight: 400;\">: Under Section 468 of CrPC, for any offence, including child abuse, the stipulated time limit for reporting an offence that is punishable by a fine is six months. But no time period forreporting of offences is mentioned in Section 19 of POCSO Act, 2012. Hence the ruling brings clarity on the issue<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Under-reporting:<\/b><span style=\"font-weight: 400;\"> As per NCRB data, average reporting of rape is 6.3 per 100000 people, while a survey in 2007 revealed that 53% children had been sexually exploited<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Lack of understanding at tender age:<\/b><span style=\"font-weight: 400;\">The victim may not have had the mental capability to fully understand until later that what they were going through was a violation of their bodies<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Remembering the event later<\/b><span style=\"font-weight: 400;\">: Memories can sometimes remain suppressed until various triggers lead them to resurface<\/span><\/li>\n<li style=\"font-weight: 400;\"><b>Addressing life-long trauma<\/b><span style=\"font-weight: 400;\">: Often, children dont report such crimes as the perpetrator is a closely known person, thus carrying the trauma of sexual abuse till very late in life.
