proposals<\/strong><\/a><\/p>\n<p><strong>News<\/strong><\/p>\n<ol>\n<li>WTO in its new report titled <strong>\u201cReinvigorating trade and Inclusive Growth\u201d <\/strong>argued to abandon <strong>consensus principle<\/strong> and introducing a <strong>case by case approach<\/strong> for plurilateral negotiations.<\/li>\n<\/ol>\n<p><strong>\u00a0 Important analysis:<\/strong><\/p>\n<ol start=\"2\">\n<li>The WTO is planning to change the<strong> \u2018consensus based multilateral rule making\u2019<\/strong> for plurilateral negotiations on grounds that it is disrupting the negotiating activity at the global trade body.<\/li>\n<li>The WTO has argued that the practice of bundling negotiating issues together in trade rounds (<u>based on the Single Undertaking)<\/u> has become extremely difficult to manage.<\/li>\n<\/ol>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-26833\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/single.jpg?resize=630%2C111&#038;ssl=1\" alt=\"\" width=\"630\" height=\"111\" Rubicon<\/strong><\/p>\n<ol start=\"4\">\n<li>Marrakesh agreement has laid out the rules for the conduct of business for the WTO secretariat.<\/li>\n<li>As per the agreement, the WTO Secretariat is required to remain neutral in negotiating new trade rules without advancing the positions of any one country or groups of countries, and is expected to respect rules in a member-driven, inter-governmental organization.<\/li>\n<\/ol>\n<p><strong>Report\u2019s Goal<\/strong><\/p>\n<ol start=\"6\">\n<li>The report\u2019s central goal is aimed at preparing the ground for the WTO\u2019s 12th ministerial conference to be held in Astana, Kazakhstan, in June or July 2020, for the launch of plurilateral negotiations in electronic commerce, investment facilitation, disciplines for MSMEs, domestic regulation for services, and gender.<\/li>\n<\/ol>\n<p><strong>Report outcome<\/strong><\/p>\n<ol start=\"7\">\n<li>The report fails to answer how the rules for plurilateral negotiations were going to be enforced and if there will be a system to settle disputes<\/li>\n<\/ol>\n<p><strong>Report Suggestions<\/strong><\/p>\n<ol start=\"8\">\n<li>The report suggested that the \u201csingle-undertaking approach\u201d has become vulnerable to delays and deadlocks.<\/li>\n<li>It is alleged that the multilateral trading system has not always relied on large-scale \u2018single undertakings\u2019 like the Uruguay Round.<\/li>\n<\/ol>\n<p>It argued that \u201cmany approaches have been deployed over the years, some fully multilateral, and others not\u201d, suggesting that \u201ckey parts of the current WTO rule book were initially agreed by and applied (in the 1970s and 1980s) only to those countries adopting the Tokyo Round Codes\u201d.<\/p>\n<p><img in consensus based approach<\/strong><\/p>\n<ol start=\"10\">\n<li>In the case of emerging issues where policy innovation is needed and where not all 164 WTO members are equipped or ready to engage, some countries wish to move further and faster than others, and are doing so.<\/li>\n<li>The open-plurilateral discussions on issues like<\/li>\n<\/ol>\n<ul>\n<li>e-commerce,<\/li>\n<li>investment facilitation,<\/li>\n<li>services domestic regulation, and<\/li>\n<li>micro, small, and medium scale enterprises (MSMEs)<\/li>\n<\/ul>\n<p>Are aimed at\u00a0 improving regulatory coordination, in order to minimize policy frictions and advance shared goals in a \u2018least trade restrictive\u2019 way that could lead to a more cooperative, less mercantilist, approach to WTO negotiations in the future.<\/p>\n<p><strong>Nature of new rules<\/strong><\/p>\n<ol start=\"12\">\n<li>New rules negotiated through plurilateral negotiations in e-commerce, domestic regulation, investment facilitation, disciplines for MSMEs, and gender would likely be inherently non-discriminatory, because they involve domestic regulations that cannot be easily tailored to benefit specific trade partners, making concerns about \u201cdiscrimination,\u201d like calculations of \u201creciprocity,\u201d less relevant\u201d.<\/li>\n<li><strong> Structure for new rules under GATS<\/strong><\/li>\n<\/ol>\n<p><strong style=\"font-size: 1rem;\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-26831\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/general.jpg?resize=627%2C161&#038;ssl=1\" alt=\"\" width=\"627\" height=\"161\" start=\"14\">\n<li>The report maintained that the General Agreement on Trade in Services (GATS) offers a structure for new agreements in electronic commerce, domestic regulation for services, investment facilitation, disciplines for MSMEs and gender.<\/li>\n<li>But the report did not reveal the gross asymmetries in market access commitments of Mode 3 and Mode 4 under GATS.<\/li>\n<\/ol>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-26830\" \/><\/p>\n<p><strong>E-commerce<\/strong><\/p>\n<ol start=\"16\">\n<li>On electronic commerce- the report advocated that members must be guided by the Comprehensive Progressive Trans-Pacific
