{"id":32696,"date":"2018-10-29T16:00:27","date_gmt":"2018-10-29T10:30:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=32696"},"modified":"2018-10-29T16:00:27","modified_gmt":"2018-10-29T10:30:27","slug":"when-woman-is-harassed-at-work","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/when-woman-is-harassed-at-work\/","title":{"rendered":"When woman is harassed at work"},"content":{"rendered":"<p><a href=\"https:\/\/indianexpress.com\/article\/explained\/sexual-harassment-at-workplace-vishaka-guidelines-metoo-5394486\/\"><strong>When woman is harassed at work<\/strong><\/a><\/p>\n<p><strong>Article<\/strong><\/p>\n<ol>\n<li>India\u2019s #MeToo movement, with editors, actors and minister being publicly accused, is breaking the culture of silence around sexual harassment and everyday sexism marks a watershed moment in societal evolution.<\/li>\n<\/ol>\n<p><strong>Sexual Harassment of Women at Workplace Act, 2013<\/strong><\/p>\n<ol start=\"2\">\n<li>The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act was passed in 2013.<\/li>\n<li>It defines sexual harassment, lays down the procedures for a complaint and inquiry, and the action to be taken. It broadens the Vishaka guidelines, which were already in place.<\/li>\n<\/ol>\n<p><strong>Vishaka guidelines<\/strong><\/p>\n<ol start=\"4\">\n<li>These were laid down by the Supreme Court in a judgment in 1997.<\/li>\n<li>This was on a case filed by women\u2019s rights groups, one of which was Vishaka.<\/li>\n<li>They had filed a public interest litigation over the alleged gang-rape of Bhanwari Devi, a social worker from Rajasthan. In 1992, she had prevented the marriage of a one-year-old girl, leading to the gang-rape in an act of revenge.<\/li>\n<\/ol>\n<p><strong>Sexual harassment as defined in the law<\/strong><\/p>\n<ol start=\"7\">\n<li>Sexual harassment includes \u201cany one or more\u201d of the following \u201cunwelcome acts or behaviour\u201d committed directly or by implication:<\/li>\n<\/ol>\n<ul>\n<li>Physical contact and advances<\/li>\n<li>A demand or request for sexual favours<\/li>\n<li>Sexually coloured remarks<\/li>\n<li>Showing pornography<\/li>\n<li>Any other unwelcome physical, verbal or non-verbal conduct of sexual nature.<img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-26621\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/handbook.jpg?resize=632%2C497&#038;ssl=1\" alt=\"\" width=\"632\" height=\"497\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/handbook.jpg?w=632&amp;ssl=1 632w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/handbook.jpg?resize=150%2C118&amp;ssl=1 150w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2018\/10\/handbook.jpg?resize=300%2C236&amp;ssl=1 300w\" sizes=\"auto, (max-width: 632px) 100vw, 632px\" \/><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Additionally, the Act mentions five circumstances that amount to sexual harassment \u2014 implied or explicit promise of preferential treatment in her employment; implied or explicit threat of detrimental treatment; implied or explicit threat about her present or future employment status; interference with her work or creating an offensive or hostile work environment; humiliating treatment likely to affect her health or safety.<\/li>\n<\/ul>\n<p><strong>Challenges of the #MeToo movement<\/strong><\/p>\n<ul>\n<li>In Public \u2018naming and shaming\u2019, there is danger of personal scores being settled in public.<\/li>\n<li>There is ethical aspects of naming harassers without them being afforded the chance to be heard and who is accountable for naming someone falsely.<\/li>\n<li>As the movement is rising, what are the institutional processes it seeks to install.<\/li>\n<\/ul>\n<ol start=\"11\">\n<li>The culture of male entitlement and patriarchy is so prevalent that most victims have thus far preferred silence to challenge these cases.<\/li>\n<li>#MeToo is a challenge to these attitudes that enforce a culture of silence.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>When woman is harassed at work Article India\u2019s #MeToo movement, with editors, actors and minister being publicly accused, is breaking the culture of silence around sexual harassment and everyday sexism marks a watershed moment in societal evolution.
