{"id":33012,"date":"2018-10-29T17:58:43","date_gmt":"2018-10-29T12:28:43","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=33012"},"modified":"2018-10-29T17:58:43","modified_gmt":"2018-10-29T12:28:43","slug":"cleaning-up","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/cleaning-up\/","title":{"rendered":"Cleaning up\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/editorial\/cleaning-up\/article22084026.ece\"><strong>Cleaning up<\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p><strong>Context<\/strong><\/p>\n<p>A permanent mechanism is needed to review laws and weed out the obsolete ones<\/p>\n<p><strong>A permanent mechanism is needed to review laws and weed out the obsolete ones<\/strong><\/p>\n<p>If law-making is a long and tedious process, it appears that unmaking existing laws is an equally arduous task<strong>\u00a0<\/strong><\/p>\n<p><strong>Backdrop<\/strong><\/p>\n<p>In the latest round, 235 outdated Acts and nine pre-Independence Ordinances have been repealed<\/p>\n<p><strong>Periodic Review<\/strong><\/p>\n<p>These pieces of legislation may have been relevant and necessary at the time they were introduced, but in the absence of a periodic review they continue to burden the statutory corpus.<\/p>\n<p><strong>Changing Conditions<\/strong><\/p>\n<p>These laws are archaic mainly because the social, economic and legal conditions that required their enactment does not obtain today; they are also not in tune with the progress of democracy since Independence<\/p>\n<p><strong>Repealed Acts<\/strong><\/p>\n<p>Among the Acts repealed are the Prevention of\u00a0Seditious Meetings Act, 1911, the Bengal Suppression of Terrorist Outrages (Supplementary) Act, 1932, and the Preventive Detention Act, 1950.<\/p>\n<p><strong>These need to be repealed too<\/strong><\/p>\n<p>The country still has a body of \u2018anti-terror\u2019 legislation as well as preventive detention laws. Although such laws remain in the statute books, these particular enactments are redundant. Other questionable legal provisions, for example, those on \u2018sedition\u2019 or exciting disaffection against the state, remain; so do \u2018adultery\u2019 and \u2018sex against the order of nature\u2019. Such obsolete concepts and notions that underlie law-making also require an overhaul.<strong>\u00a0<\/strong><\/p>\n<p><strong>Acts were repealed in the past too<\/strong><\/p>\n<ul>\n<li>In a 2014 interim report, the first of four such reports on obsolete\u00a0laws,\u00a0the Law Commission noted that the panel had been identifying Acts for repeal in many of its reports in the past<\/li>\n<li>Its 96th and 148th Reports recommended a good number of such laws. In 1998, the P.C.
