One of the major concerns regarding the draft rules is the <strong>government&#8217;s control over appointments<\/strong> to the <strong>Data Protection Board (DPB)<\/strong>, which could compromise its independence. Another issue is the <strong>feasibility of the dispute resolution mechanism<\/strong>, as appeals from the DPB will be handled by the <strong>Telecom Disputes Settlement and Appellate Tribunal (TDSAT)<\/strong>. The article highlights key institutional reforms needed to equip the TDSAT for this role.<\/p>\n<h2><strong>About TDSAT<\/strong><\/h2>\n<ol>\n<li>Telecom Disputes Settlement &amp; Appellate Tribunal (TDSAT) was established in <strong>2000<\/strong> by the <strong>Government of India<\/strong> under the <strong>Telecom Regulatory Authority of India Act, 1997<\/strong> (TRAI Act)<\/li>\n<li><strong>Objective:<\/strong> To adjudicate disputes and hear appeals related to telecom, broadcasting, and information technology services in India.<\/li>\n<\/ol>\n<p>For detailed information on<strong> TDSAT <\/strong><a href=\"https:\/\/forumias.com\/blog\/telecom-disputes-settlement-appellate-tribunal-tdsat\/#:~:text=It%20provides%20a%20specialized%20dispute,allocation,%20and%20digital%20broadcasting%20disputes.\"><strong>read this article here<\/strong><\/a><\/p>\n<h2><strong>Evolution of the Appellate Mechanism<\/strong><\/h2>\n<ol>\n<li>The <strong>Justice B.N. Srikrishna Committee (2018)<\/strong> recommended establishing a <strong>separate tribunal<\/strong> for data protection disputes, recognizing the need for <strong>specialized adjudication<\/strong>.<\/li>\n<li>In line with this, the <strong>2018 Personal Data Protection Bill<\/strong> proposed setting up a <strong>dedicated tribunal<\/strong>.<\/li>\n<li>However, the <strong>2022 draft Bill<\/strong> shifted appeals to <strong>High Courts<\/strong>, possibly to ensure stronger judicial oversight.<\/li>\n<li>The final <strong>2023 Act designated TDSAT<\/strong> as the appellate body, raising concerns about <strong>its lack of data protection expertise and existing backlog<\/strong>.<\/li>\n<\/ol>\n<h2><strong>Key Issues with TDSAT<\/strong><\/h2>\n<ol>\n<li><strong> Lack of Data Protection Expertise<\/strong>: TDSAT members are required to have expertise in <strong>technology, telecom, industry, commerce, or administration<\/strong> (Section 14C, TRAI Act, 1997), but <strong>not in data protection<\/strong>. Data protection issues, like <strong>consent, storage, and unauthorized use of data<\/strong>, are distinct from telecom matters.<\/li>\n<li><strong>Heavy Case Backlog<\/strong>: As of <strong>February 2025, 3,448 cases are pending<\/strong>. Additional cases under the <strong>Telecommunications Act, 2023<\/strong>, and <strong>Digital Personal Data Protection Act, 2023<\/strong>, will further burden TDSAT.<\/li>\n<li><strong>Judicial Member Shortage<\/strong>: In <strong>January 2025, TDSAT had only one technical member<\/strong> on its sole bench, lacking a <strong>judicial member<\/strong>, which the <strong>Supreme Court recommends for tribunals<\/strong>.<\/li>\n<li><strong>Weak Digital Infrastructure<\/strong>: Digital appeals are mandated, but <strong>TDSAT<\/strong><strong>\u2019<\/strong><strong>s website is inefficient<\/strong>. The <strong>Legal Cases Management System<\/strong><strong>\u2019<\/strong><strong>s<\/strong> impact is unclear (TRAI Annual Report, 2023).<\/li>\n<li><strong> Lack of Transparency<\/strong>: TDSAT does not publish <strong>detailed annual reports<\/strong> on <strong>appeals, decisions, and case categories<\/strong>.<\/li>\n<\/ol>\n<h2><strong>Needed Reforms<\/strong><\/h2>\n<ol>\n<li><strong>Appoint a Data Protection Expert in TDSAT<\/strong>: Amend <strong>Section 14C of the TRAI Act, 1997<\/strong> to include <strong>data protection expertise<\/strong> in member qualifications. This is necessary as <strong>data protection cases<\/strong> differ from telecom disputes.<\/li>\n<li><strong> Increase TDSAT<\/strong><strong>\u2019<\/strong><strong>s Capacity<\/strong>: <strong>3,448 cases were pending (Feb 2020\u2013Feb 2025)<\/strong>. The <strong>Telecommunications Act, 2023<\/strong>will add more cases. Expand <strong>benches and budget<\/strong> to meet the <strong>six-month deadline<\/strong>.<\/li>\n<li><strong>Upgrade Digital Infrastructure<\/strong>: The <strong>Legal Cases Management System<\/strong><strong>\u2019<\/strong><strong>s impact is unclear<\/strong>.
