{"id":33179,"date":"2018-10-30T11:15:27","date_gmt":"2018-10-30T05:45:27","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=33179"},"modified":"2018-10-30T11:15:27","modified_gmt":"2018-10-30T05:45:27","slug":"cabinet-nod-for-bill-making-instant-triple-talaq-a-crime","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/cabinet-nod-for-bill-making-instant-triple-talaq-a-crime\/","title":{"rendered":"Cabinet\u00a0nod\u00a0for\u00a0Bill\u00a0making instant\u00a0triple\u00a0talaq\u00a0a\u00a0crime"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/news\/national\/govt-clears-bill-banning-instant-triple-talaq\/article21679481.ece\"><strong>Cabinet\u00a0nod\u00a0for\u00a0Bill\u00a0making instant\u00a0triple\u00a0talaq\u00a0a\u00a0crime<\/strong><\/a><\/p>\n<p><strong>Context<\/strong><\/p>\n<p>The Union Cabinet on Friday approved a Bill that makes\u00a0instant triple talaq\u00a0or t<em>alaq-e-biddat<\/em>\u00a0a criminal offence and a Muslim husband resorting to instant talaq can be jailed for up to three years.<\/p>\n<p><strong>This Bill will adjudicate all cases of instant triple talaq across the country except Jammu and Kashmir.<\/strong><\/p>\n<ul>\n<li>The government intends to introduce the Bill in the winter session of Parliament that got under way on Friday<\/li>\n<li>Last month, the Law Ministry had written to all the States for their comments and asked them to revert urgently.<\/li>\n<\/ul>\n<p><strong>Muslim Women Protection of Rights on Marriage Bill<\/strong><\/p>\n<p>The proposed Muslim Women Protection of Rights on Marriage Bill will deal with complaints against instant triple talaq across the country, except Jammu and Kashmir.<\/p>\n<p><strong>Subsistence allowance<\/strong><\/p>\n<ul>\n<li>As per provisions of the draft Bill, earlier reported by\u00a0<em>The Hindu,<\/em>a husband who resorts to instant triple talaq can be fined or face a jail term of up to three years.<\/li>\n<li>Instant triple talaq in any form \u2014 oral, written or electronic form \u2014 has been banned and made a cognisable offence<\/li>\n<li>The Bill also provides for a subsistence allowance of a harassed Muslim woman and her dependent children and the custodial rights of minor children.<\/li>\n<\/ul>\n<p><strong>Practice Continues<\/strong><\/p>\n<ul>\n<li>The government sources say data suggests even after the judgement, there have been 66 cases of instant\u00a0divorce\u00a0until November.<\/li>\n<li>And before the judgment, there were 177 cases with Uttar Pradesh and Bihar recording the maximum number of cases.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Cabinet\u00a0nod\u00a0for\u00a0Bill\u00a0making instant\u00a0triple\u00a0talaq\u00a0a\u00a0crime Context The Union Cabinet on Friday approved a Bill that makes\u00a0instant triple talaq\u00a0or talaq-e-biddat\u00a0a criminal offence and a Muslim husband resorting to instant talaq can be jailed for up to three years.
