Based on interactions with <strong>8,276 police personnel<\/strong> across <strong>17 states and union territories<\/strong>, the report explores the <strong>nature, causes, and extent<\/strong> of police violence in India.<\/p>\n<p>For detailed information on <strong>Custodial Violence in India<\/strong> <a href=\"https:\/\/forumias.com\/blog\/custodial-violence-in-india-explained-pointwise\/\">read this article here<\/a><\/p>\n<ol>\n<li><strong>Torture Targets<\/strong><strong>:<\/strong> Victims of police torture are mostly from <strong>poor and marginalised communities<\/strong>, such as <strong>Dalits, Adivasis, Muslims, illiterates<\/strong>, and <strong>slum dwellers<\/strong>. These groups are highly vulnerable and often lack access to legal safeguards.<\/li>\n<li><strong>Custodial Deaths and Discrepancies: <\/strong>There are major differences in data on custodial deaths. In 2020, the <strong>NCRB reported 76 cases<\/strong>, the <strong>NHRC reported 70<\/strong>, and the <strong>NCAT recorded 111<\/strong> cases. Disturbingly, between <strong>2018 and 2022<\/strong>, there were <strong>zero convictions<\/strong> for deaths in police custody.<\/li>\n<li><strong>Prevalence of Harsh Methods:<\/strong> About <strong>55% of police personnel<\/strong> support using \u201c<strong>tough methods<\/strong>\u201d to instil fear among the public. This includes <strong>20% who think it is very important<\/strong> and <strong>35% who think it is somewhat important<\/strong>.<\/li>\n<li><strong>Justification of Extra-Judicial Actions:<\/strong> <strong>One in four police personnel<\/strong> justify <strong>mob violence<\/strong> in sensitive cases like <strong>child lifting and sexual harassment<\/strong>. Also, <strong>22% believe<\/strong> that killing dangerous criminals is better than giving them a legal trial.<\/li>\n<li><strong>Procedural Non-Compliance<\/strong><strong>:<\/strong> Only <strong>41%<\/strong> of police personnel say that arrest procedures are <strong>always followed<\/strong>, while <strong>24% admit<\/strong> they are \u201c<strong>rarely or never<\/strong>\u201d followed. <strong>Kerala<\/strong> showed the best compliance, with <strong>94%<\/strong> reporting that procedures are followed.<\/li>\n<li><strong>Inadequate Accountability Measures:<\/strong> The report criticises the role of <strong>judiciary and medical professionals<\/strong>. <strong>Magistrates<\/strong> are often \u201c<strong>silent spectators<\/strong>\u201d during remand hearings. Medical examinations are sometimes conducted by <strong>non-forensic experts<\/strong>, such as <strong>eye specialists<\/strong> or <strong>anaesthesiologists<\/strong>.<\/li>\n<li><strong>Training and Reform Support:<\/strong> There is strong support for reform. 79% of police personnel favour human rights training and evidence-based interrogation techniques. But this cannot justify its use in India.<\/li>\n<li>The report recommends that India should <strong>enact an anti-torture law<\/strong>, <strong>ratify the UN Convention Against Torture<\/strong>, and <strong>insulate police from political pressure<\/strong> as directed by the <strong>Supreme Court<\/strong>. 3.
