Context<\/strong>: On 26th March 2025<\/strong>, Common Cause<\/em> and the Lokniti Programme of CSDS<\/em> released a comprehensive report on police torture and lack of accountability in India. Based on interactions with 8,276 police personnel<\/strong> across 17 states and union territories<\/strong>, the report explores the nature, causes, and extent<\/strong> of police violence in India.<\/p>\n

  1. Torture Targets<\/strong>:<\/strong> Victims of police torture are mostly from poor and marginalised communities<\/strong>, such as Dalits, Adivasis, Muslims, illiterates<\/strong>, and slum dwellers<\/strong>. These groups are highly vulnerable and often lack access to legal safeguards.<\/li>\n
  2. Custodial Deaths and Discrepancies: <\/strong>There are major differences in data on custodial deaths. In 2020, the NCRB reported 76 cases<\/strong>, the NHRC reported 70<\/strong>, and the NCAT recorded 111<\/strong> cases. Disturbingly, between 2018 and 2022<\/strong>, there were zero convictions<\/strong> for deaths in police custody.<\/li>\n
  3. Prevalence of Harsh Methods:<\/strong> About 55% of police personnel<\/strong> support using \u201ctough methods<\/strong>\u201d to instil fear among the public. This includes 20% who think it is very important<\/strong> and 35% who think it is somewhat important<\/strong>.<\/li>\n
  4. Justification of Extra-Judicial Actions:<\/strong> One in four police personnel<\/strong> justify mob violence<\/strong> in sensitive cases like child lifting and sexual harassment<\/strong>. Also, 22% believe<\/strong> that killing dangerous criminals is better than giving them a legal trial.<\/li>\n
  5. Procedural Non-Compliance<\/strong>:<\/strong> Only 41%<\/strong> of police personnel say that arrest procedures are always followed<\/strong>, while 24% admit<\/strong> they are \u201crarely or never<\/strong>\u201d followed. Kerala<\/strong> showed the best compliance, with 94%<\/strong> reporting that procedures are followed.<\/li>\n
  6. Inadequate Accountability Measures:<\/strong> The report criticises the role of judiciary and medical professionals<\/strong>. Magistrates<\/strong> are often \u201csilent spectators<\/strong>\u201d during remand hearings. Medical examinations are sometimes conducted by non-forensic experts<\/strong>, such as eye specialists<\/strong> or anaesthesiologists<\/strong>.<\/li>\n
  7. Training and Reform Support:<\/strong> There is strong support for reform. 79% of police personnel favour human rights training and evidence-based interrogation techniques. Also, 71% support preventive steps against torture.<\/li>\n<\/ol>\n

    Way Forward<\/strong><\/h2>\n

    1. Torture is a global issue<\/strong>, with known cases in countries like the US, China, Pakistan<\/strong>, and Russia<\/strong>. But this cannot justify its use in India.<\/li>\n
    2. The report recommends that India should enact an anti-torture law<\/strong>, ratify the UN Convention Against Torture<\/strong>, and insulate police from political pressure<\/strong> as directed by the Supreme Court<\/strong>. 3. These steps can build a more humane<\/strong>, lawful<\/strong>, and trusted police force<\/strong>.<\/li>\n<\/ol>\n
