Context<\/strong>: The issue of reservation in private higher educational institutions (PHEIs) has returned to public discussion after Congress leader Jairam Ramesh reiterated support for it. The legality of such reservations is already settled. What remains is political will. The idea is timely, and action is now needed.<\/p>\n

Necessary Reservation in Private Universities<\/strong><\/h2>\n
    \n
  1. The idea has legal backing since 2005<\/strong>, with Article 15(5)<\/strong> allowing reservation for SCs, STs, and OBCs<\/strong> in aided and unaided private institutions<\/strong> (excluding minority institutions).<\/li>\n
  2. The Supreme Court upheld<\/strong> this in cases like IMA vs Union of India<\/em> (2011) and Pramati Trust<\/em> (2014).<\/li>\n
  3. The Congress party has long supported<\/strong> this policy. Its 2024 manifesto<\/strong> included the demand.<\/li>\n
  4. However, political will is still lacking<\/strong>, even though the idea\u2019s time had \u201ccome long ago\u201d.<\/li>\n<\/ol>\n

    Private higher education key to social inequality <\/strong><\/h2>\n
      \n
    1. Higher education now reflects what scholars call “effectively maintained inequality”<\/strong>.<\/li>\n
    2. As SCs, STs, and OBCs enter education, elite private institutions<\/strong> (with better faculty, classrooms, and placements) remain out of their reach.<\/li>\n
    3. Meanwhile, public institutions<\/strong>, which these groups depend on, are underfunded, overcrowded, and declining in quality<\/strong>.<\/li>\n
    4. Example: From 2015 to 2024<\/strong>, private universities rose from 276 to 523<\/strong>, and now form 26%<\/strong> of enrolments. Private unaided colleges host 45%<\/strong> of total college students.<\/li>\n<\/ol>\n

      Social composition of students in private vs public institutions<\/strong><\/h2>\n
        \n
      1. Upper-caste Hindus<\/strong> (20% of population) form over 60%<\/strong> of students in private universities.<\/li>\n
      2. In contrast, SCs (6.8%)<\/strong>, STs (3.6%)<\/strong>, and OBCs (24.9%)<\/strong> are severely underrepresented, despite making up 17%, 9%, and 45\u201350%<\/strong> of the population respectively.<\/li>\n
      3. Muslims (15% population) form only 3.8%<\/strong> of enrolment.<\/li>\n
      4. Public universities<\/strong>, which follow reservation: SCs: 14.6%<\/strong>, STs: 6%<\/strong>, OBCs: 31.2%<\/strong><\/li>\n<\/ol>\n

        This shows that quota-based affirmative action does work<\/strong>.<\/p>\n
