The legality of such reservations is already settled. What remains is political will. The idea is timely, and action is now needed.<\/p>\n<h2><strong>Necessary Reservation in Private Universities<\/strong><\/h2>\n<ol>\n<li>The idea has <strong>legal backing since 2005<\/strong>, with <strong>Article 15(5)<\/strong> allowing reservation for <strong>SCs, STs, and OBCs<\/strong> in <strong>aided and unaided private institutions<\/strong> (excluding minority institutions).<\/li>\n<li>The <strong>Supreme Court upheld<\/strong> this in cases like <em>IMA vs Union of India<\/em> (2011) and <em>Pramati Trust<\/em> (2014).<\/li>\n<li>The <strong>Congress party has long supported<\/strong> this policy. Its <strong>2024 manifesto<\/strong> included the demand.<\/li>\n<li>However, <strong>political will is still lacking<\/strong>, even though the idea\u2019s time had \u201ccome long ago\u201d.<\/li>\n<\/ol>\n<h2><strong>Private higher education key to social inequality <\/strong><\/h2>\n<ol>\n<li>Higher education now reflects what scholars call <strong>&#8220;effectively maintained inequality&#8221;<\/strong>.<\/li>\n<li>As SCs, STs, and OBCs enter education, <strong>elite private institutions<\/strong> (with better faculty, classrooms, and placements) remain out of their reach.<\/li>\n<li>Meanwhile, <strong>public institutions<\/strong>, which these groups depend on, are <strong>underfunded, overcrowded, and declining in quality<\/strong>.<\/li>\n<li>Example: From <strong>2015 to 2024<\/strong>, private universities rose from <strong>276 to 523<\/strong>, and now form <strong>26%<\/strong> of enrolments. Private unaided colleges host <strong>45%<\/strong> of total college students.<\/li>\n<\/ol>\n<h2><strong>Social composition of students in private vs public institutions<\/strong><\/h2>\n<ol>\n<li><strong>Upper-caste Hindus<\/strong> (20% of population) form <strong>over 60%<\/strong> of students in private universities.<\/li>\n<li>In contrast, <strong>SCs (6.8%)<\/strong>, <strong>STs (3.6%)<\/strong>, and <strong>OBCs (24.9%)<\/strong> are severely underrepresented, despite making up <strong>17%, 9%, and 45\u201350%<\/strong> of the population respectively.<\/li>\n<li>Muslims (15% population) form only <strong>3.8%<\/strong> of enrolment.<\/li>\n<li><strong>Public universities<\/strong>, which follow reservation: SCs: <strong>14.6%<\/strong>, STs: <strong>6%<\/strong>, OBCs: <strong>31.2%<\/strong><\/li>\n<\/ol>\n<p>This shows that <strong>quota-based affirmative action does work<\/strong>.<\/p>\n<h2><strong>Change in higher education landscape in India<\/strong><\/h2>\n<p>Two major trends:<\/p>\n<ol>\n<li><strong> Increased enrolment by disadvantaged groups<\/strong>: Between 1990\u201391 and 2018\u201319<\/li>\n<\/ol>\n<ul>\n<li>Universities: <strong>5.5\u00d7 <\/strong><strong>rise<\/strong>, Enrolment: <strong>7.5\u00d7 <\/strong><strong>rise<\/strong>, GER: <strong>2.5\u00d7 <\/strong><strong>rise<\/strong><\/li>\n<li>Growth is <strong>faster among SCs, STs, OBCs, Muslims<\/strong>, and <strong>women<\/strong> within these groups.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong>Collapse of public education + rise of private education<\/strong>:<\/li>\n<\/ol>\n<ul>\n<li>Public colleges are turning into <strong>&#8220;time-pass&#8221; institutes<\/strong>, lacking quality and job prospects.<\/li>\n<li>Private institutions now offer <strong>top-tier education<\/strong>, but with <strong>no social diversity<\/strong>.<\/li>\n<\/ul>\n<h2><strong>Way forward <\/strong><\/h2>\n<ol>\n<li><strong>Strengthen public institutions<\/strong>: More funds, better governance, regular faculty, autonomy, updated curriculum.<\/li>\n<li><strong>Enforce reservation in private HEIs<\/strong>: Mandate quota for SC, ST, OBCs in all non-minority private institutions.<\/li>\n<li><strong>Add freeships and scholarships<\/strong>: A fixed share of students must get financial support.<\/li>\n<li>Despite the <strong>National Education Policy&#8217;s promises<\/strong>, it has done little to stop <strong>privatisation and commercialisation<\/strong>.<\/li>\n<li>This policy shift can also help <strong>unite Dalits, Adivasis, and OBCs<\/strong> under a <strong>common social justice platform<\/strong>.<\/li>\n<\/ol>\n<p><strong>Conclusion:<\/strong><\/p>\n<p>The legal and moral arguments for reservation in private education are clear. What\u2019s missing is <strong>political urgency<\/strong>.
