This addition is crucial, considering they can be used instead of a physical form of biodiversity.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>Key Highlights<\/h2>\n<ul>\n<li><strong>Benefit sharing is linked to turnover:<\/strong> The Regulation has set <strong>slabs based on the annual turnover of the person or the industry accessing the resource.<\/strong><\/li>\n<\/ul>\n<table>\n<tbody>\n<tr>\n<td style=\"width: 340.198px; text-align: center;\"><strong>Turnover (in Cr. Rs.)<\/strong><\/td>\n<td style=\"width: 351.125px; text-align: center;\"><strong>Amount of Benefit Sharing (% of the annual gross ex-factory sale price of the product, excluding government taxes)<\/strong><\/td>\n<\/tr>\n<tr>\n<td style=\"width: 340.198px; text-align: center;\"><strong>Upto Rs 5 crores<\/strong><\/td>\n<td style=\"width: 351.125px; text-align: center;\">Not applicable<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 340.198px; text-align: center;\"><strong>Rs 5 crore &#8211; Rs 50 crore<\/strong><\/td>\n<td style=\"width: 351.125px; text-align: center;\">0.2 %<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 340.198px; text-align: center;\"><strong>Rs 50 crore -250 crore<\/strong><\/td>\n<td style=\"width: 351.125px; text-align: center;\">0.4 %<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 340.198px; text-align: center;\"><strong>Above Rs 250 crore<\/strong><\/td>\n<td style=\"width: 351.125px; text-align: center;\">0.6 %<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong><em>Note &#8211;<\/em><\/strong> <strong>All users<\/strong> who have <strong>an annual turnover of over 1 crore<\/strong> need to shar<strong>e a statement with information on the resources used per year.<\/strong><\/p>\n<ul>\n<li><strong>In case of biological resources that have high conservation or economic value,<\/strong> the benefit sharing shall <strong>not be less than five per cent<\/strong> of the proceeds of the auction or sale amount or the purchase price.\n<ul>\n<li>The benefit sharing component could go up to <strong>more than 20 per cent in case of commercial use.<\/strong><\/li>\n<li>These resources include <strong>red sanders, sandalwood, agarwood and threatened<\/strong> species notified under <strong>Section 38 of the Biodiversity Act 2002<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Digital Sequence Information:<\/strong> The Regulation includes <strong>digital sequence information<\/strong> in the ambit of <strong>genetic resources<\/strong>.\n<ul>\n<li>A multilateral <strong>mechanism<\/strong> for sharing benefits accrued from the use of <strong>digital sequence information<\/strong> was put in place during <strong>COP16 of the Convention on Biological Diversity in Cali, Colombia, in 2024.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Exemption to cultivated medicinal plants: <\/strong>The Regulation <strong>exempts users of cultivated medicinal plants <\/strong>in line with the <strong>Biological Diversity (Amendment) Act 2023.<\/strong>\n<ul>\n<li>The <strong>Amendment<\/strong> <strong>Act<\/strong> promoted cultivation of medicinal plants and <strong>freed the practitioners of Indian systems of medicine from the need to take approvals<\/strong> for access or share benefits.<\/li>\n<li>In case a product contains both <strong>cultivated and uncultivated plants<\/strong>, benefits would not need to be shared on products identified by the <strong>MoEFCC<\/strong> <strong>in consultation with the AYUSH<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Benefit sharing by researchers:<\/strong> The Regulation also puts in place, the requirements for benefit sharing by <strong>researchers<\/strong> and for those who want to <strong>apply for intellectual property rights<\/strong>.<\/li>\n<li>The Regulation also outlines <strong>how benefits would be shared with the claimants<\/strong>.\n<ul>\n<li>Of the total collected, around 10-15 per cent would be retained by the National Biodiversity Authority.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>About Access and Benefit-Sharing (ABS)<\/h2>\n<ul>\n<li>ABS refers to the <strong>way in which genetic resources may be accessed<\/strong>, and how users and providers reach agreement on the <strong>fair and equitable sharing<\/strong> of the benefits that might result from their use.<\/li>\n<li><strong>Origin: Article 15 of the Convention on Biological Diversity (CBD)<\/strong> sets out <strong>rules<\/strong> which govern access and benefit-sharing.<\/li>\n<li><strong>Nagoya Protocol to CBD: <\/strong>The <strong>Nagoya Protocol, adopted in 2010<\/strong> under the CBD, provides a <strong>legally binding framework<\/strong> for access to genetic resources and fair benefit-sharing.\n<ul>\n<li>In India, ABS is implemented through the <strong>Biological Diversity Act, 2002) and ABS Regulation, 2025. <\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The National Biodiversity Authority (NBA) has released a new set of rules to manage sharing of benefits generated through the use of biological resources.
