{"id":33639,"date":"2018-10-30T13:24:28","date_gmt":"2018-10-30T07:54:28","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=33639"},"modified":"2018-10-30T13:24:28","modified_gmt":"2018-10-30T07:54:28","slug":"telecom-regulator-backs-net-neutrality","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/telecom-regulator-backs-net-neutrality\/","title":{"rendered":"Telecom regulator backs net neutrality\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/sci-tech\/technology\/internet\/trai-backs-net-neutrality\/article21037516.ece\"><strong>Telecom regulator backs net neutrality<\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<p><strong>Context <\/strong><\/p>\n<p>The Telecom Regulatory Authority of India (TRAI) on Tuesday came out in strong support of Net neutrality in a series of recommendations following a long process of consultations on the issue<\/p>\n<p><strong>TRAI\u2019s recommendations<\/strong><\/p>\n<ul>\n<li>The licensing terms should be amplified to provide explicit restrictions on any sort of discrimination in Internet access based on the <strong><u>content<\/u><\/strong> being accessed, the protocols being used or the user equipment being deployed<\/li>\n<\/ul>\n<p><strong>What does the word \u2018content\u2019 include?<\/strong><\/p>\n<p>The content mentioned includes all content, applications, services and any other data, including its end-point information that can be accessed or transmitted over the Internet<\/p>\n<ul>\n<li><strong>Preventing discriminatory treatment<\/strong>: Warning against any \u201cdiscriminatory treatment\u201d including blocking, degrading, slowing down or granting preferential speeds to any content, TRAI stated, \u201cThe scope of the proposed principles on non-discriminatory treatment apply specifically to \u2018Internet Access Services\u2019, which are generally available to the public<\/li>\n<li><strong>Restriction on any discriminatory agreements<\/strong>: The service providers should be restricted from entering into any arrangement, agreement or contract, by whatever name called, with any person, natural or legal, that has the effect of discriminatory treatment based on content, sender or receiver, protocols or user equipment<\/li>\n<li><strong>Creation of a multi-stakeholder body<\/strong>: To monitor violations, TRAI has recommended the establishment of a collaborative mechanism in the form of a multi-stakeholder body which would be responsible for developing technical standards for monitoring and enforcement of the principles<\/li>\n<\/ul>\n<p><strong>Backdrop<\/strong><\/p>\n<ul>\n<li>In February 2016, TRAI had barred telecom providers from charging differential rates for data services in its <strong>Prohibition of Discriminatory Tariffs for Data Services Regulations, 2016<\/strong>, effectively blocking such attempts by Facebook and Airtel<\/li>\n<li>Facebook had earlier rolled out its <strong>Free Basics service<\/strong> in partnership with Reliance Communications as a \u201cdifferential service\u201d and lobbied hard for it on social media<\/li>\n<li>Present recommendations have been arrived at based on the pre-consultation paper issued in May 2016 to identify key issues and a detailed consultation paper in January 2017 which focussed on identifying the requirements, design, scope and implementation of Net neutrality framework in India.
