Can we ask the government to ratify a treaty by way of a mandamus,\u201d Chief Justice Misra asked Mr. Kumar<\/li>\n<li>Justice D.Y. Chandrachud, on the Bench, said the government \u201chas to take a political decision on whether or not it should ratify the treaty\u201d.<\/li>\n<\/ul>\n<p><strong>Law commission\u2019s view<\/strong><\/p>\n<ul>\n<li>The Law Commission has recommended that the Centre ratify the <strong>United Nations Convention against Torture<\/strong> and frame a standalone anti-torture law, making the state responsible for any injury inflicted by its agents on citizens<\/li>\n<li>The commission has said the state should not claim immunity for the actions of its officers or agents<\/li>\n<li><strong>Prevention of Torture Bill<\/strong>: In its 273rd report handed over to the Law Ministry, the commission has proposed the Prevention of Torture Bill, 2017, which gives a wide definition to torture, not limited to physical pain but also including \u201cinflicting injury, either intentionally or involuntarily, or even an attempt to cause such an injury, which will include physical, mental or psychological in nature\u201d<\/li>\n<\/ul>\n<p><strong>Government\u2019s view<\/strong><\/p>\n<p>Union Government said that it is considering an anti-torture law<\/p>\n<p><strong>United Nations Convention Against Torture (UNCAT)<\/strong><\/p>\n<ul>\n<li>It is an\u00a0international human rights treaty, under the review of the\u00a0United Nationsthat aims to prevent\u00a0torture\u00a0and other acts of\u00a0cruel, inhuman, or degrading treatment or punishmentaround the world.<\/li>\n<li>The Convention requires states to take effective measures to prevent torture in any\u00a0territory\u00a0under their\u00a0jurisdiction, and forbids states to transport people to any country where there is reason to believe they will be tortured<\/li>\n<li>The text of the Convention was adopted by the\u00a0United Nations General Assembly\u00a0on 10 December 1984and, following ratification by the 20th state party,it came into force on 26 June 1987.<a href=\"https:\/\/en.wikipedia.org\/wiki\/United_Nations_Convention_against_Torture#cite_note-untc-1\"><sup>[1]<\/sup><\/a>\u00a026 June is now recognized as the\u00a0International Day in Support of Victims of Torture, in honor of the Convention<\/li>\n<\/ul>\n<p><strong>Has India signed or ratified it?<\/strong><\/p>\n<p>Though India signed the convention in 1997, it is yet to ratify it<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cant force govt. to frame a\u00a0 law:SC\u00a0 Context The Supreme Court has \u00a0said it respected the government\u2019s \u201cpolitical compulsions\u201d and would not compel it to ratify the UN Convention against Torture, or command it to frame a standalone anti-torture legislation What has happened?
