{"id":33961,"date":"2018-10-30T15:12:47","date_gmt":"2018-10-30T09:42:47","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=33961"},"modified":"2018-10-30T15:12:47","modified_gmt":"2018-10-30T09:42:47","slug":"overreach","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/overreach\/","title":{"rendered":"Overreach"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/editorial\/overreach\/article20492676.ece\"><span style=\"font-weight: 400;\">Overreach<\/span><\/a><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is an act of constitutional impropriety for the Governor of a State to review the work of government officials when an elected regime is in place. <\/span><\/li>\n<\/ul>\n<p><b>Why is it in news?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Recently in news, by holding meetings in Coimbatore to review programmes, the Tamil Nadu Governor has left himself open to charges.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Justifications say that it was an attempt to <\/span><b>familiarise with the administration and that could appreciate its work in implementing schemes only if he got to know all details first hand<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><b>Why this act is constitutional impropriety?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Article 167 of the Constitution says it is the Chief Minister\u2019s duty to communicate to the Governor<\/b><span style=\"font-weight: 400;\"> about all decisions of the Council of Ministers<\/span> <span style=\"font-weight: 400;\">relating to the administration and proposals for legislation.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It enjoins the Chief Minister to furnish such information relating to the administration as the Governor may call for.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">There may be occasions when the Governor may need to ask a top bureaucrat or the head of the police force for a report on a major incident or development, but even that should be for the limited purpose of getting an accurate picture before sending a report to the Centre.<\/span><\/li>\n<\/ul>\n<p><b>Conclusion:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Governor\u2019s familiarisation exercise is <\/span><b>bound to be read for signs of what the future has in store<\/b><span style=\"font-weight: 400;\">. <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It opens up a <\/span><b>prospect of the State coming under a spell of President\u2019s Rule if the present regime formally loses its majority in the House<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">But the <\/span><b>functioning of the Governor should be within the bounds of established norms and conventions.<\/b><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Overreach Context: It is an act of constitutional impropriety for the Governor of a State to review the work of government officials when an elected regime is in place.
