Every year, <strong>June 12<\/strong> is observed as <strong>World Day Against Child Labour<\/strong> under the auspices of ILO. Its aim is to draw the attention of the world towards the issue of child labour. <strong>SDG Target 8.7<\/strong> calls on global community to take effective measures to end child labour in all forms by 2025. <strong>Child labour in India<\/strong><br \/>\nAcross the world, there are 160mn children engaged in child labour i.e. nearly one among 10 children. The Africa, Asia &amp; Pacific regions together account for almost 9 out of every 10 children in child labour. What is the Extent of Child Labour in India?<\/span><\/strong><\/span><\/h2>\n<ul>\n<li><strong>Child Labour:<\/strong>\u00a0According to International Labour Organisation (ILO), child labour is a work that <span style=\"color: #ff0000;\">deprives children of their childhood<\/span>, their <span style=\"color: #ff0000;\">potential and dignity<\/span>, and that is <span style=\"color: #ff0000;\">harmful to their physical and mental development<\/span>.<\/li>\n<li>However, children or adolescents who participate in work <span style=\"color: #ff0000;\">that does not affect their health<\/span> <span style=\"color: #ff0000;\">and personal development<\/span> or <span style=\"color: #ff0000;\">interferes with their schooling<\/span>, is not child labour. <strong>For ex-<\/strong> Helping their parents at home, assisting family or earning pocket money outside school hours and on holidays.<\/li>\n<\/ul>\n<p><strong>Child Labour in India Statistics:<\/strong><\/p>\n<table style=\"width: 100%; border-collapse: collapse; border-style: solid;\">\n<tbody>\n<tr>\n<td style=\"width: 27.3334%;\"><strong>Number of Child Labourers in India<\/strong><\/td>\n<td style=\"width: 72.6666%;\">According to the last available <strong><span style=\"color: #ff0000;\">Census 2011<\/span><\/strong>, there were <span style=\"color: #ff0000;\">10.1 million child labourers<\/span> in India. According to the <strong><span style=\"color: #ff0000;\">International Labour Organisation<\/span>,<\/strong> India has the<span style=\"color: #ff0000;\"> highest number of child labourers<\/span> in the 5-17 age range in South Asia.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 27.3334%;\"><strong>NCRB Report on Child Labour<\/strong><\/td>\n<td style=\"width: 72.6666%;\">According to <span style=\"color: #ff0000;\">NCRB Report 2022<\/span>, in <span style=\"color: #ff0000;\">2021<\/span>, around 982 cases were registered under the <span style=\"color: #ff0000;\">Child Labour<\/span> (<span style=\"color: #ff0000;\">Prohibition and Regulation<\/span>) <span style=\"color: #ff0000;\">Act<\/span>, <span style=\"color: #ff0000;\">1986<\/span>. The highest number of cases were registered in Telangana, followed by Assam.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 27.3334%;\"><strong>Impact of COVID-19 on Child Labour<\/strong><\/td>\n<td style=\"width: 72.6666%;\">According to a study by <span style=\"color: #ff0000;\">Campaign Against Child Labour<\/span> (<span style=\"color: #ff0000;\">CACL<\/span>), there has been a significant increase in Child labour in India. According to a <span style=\"color: #ff0000;\">new report<\/span> by the <span style=\"color: #ff0000;\">International Labour Organisation<\/span> (<span style=\"color: #ff0000;\">ILO<\/span>) and <span style=\"color: #ff0000;\">UNICEF<\/span>, the number of children in child labour has increased to 160 million worldwide.<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 27.3334%;\"><strong>Biggest Employers of Child Labour In India<\/strong><\/td>\n<td style=\"width: 72.6666%;\">India\u2019s biggest child labour employers are- <span style=\"color: #ff0000;\">Uttar Pradesh<\/span>, <span style=\"color: #ff0000;\">Bihar<\/span>, <span style=\"color: #ff0000;\">Rajasthan<\/span>, <span style=\"color: #ff0000;\">Madhya Pradesh<\/span>, and <span style=\"color: #ff0000;\">Maharashtra.<br \/>\n<span style=\"color: #000000;\">Child labour is preferred in beedi, carpet weaving &amp; firework factories.\u00a0<\/span><br \/>\n<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"text-decoration: underline;\"><span style=\"color: #000000; text-decoration: underline;\"><strong><a id=\"toc2\"><\/a>What are the Causes of Child Labour in India?<\/strong><\/span><\/span><\/h2>\n<p><strong>1. Poverty and Indebtedness: <\/strong>Poverty is the greatest cause of child labour in India. For impoverished households, income from a child\u2019s work is crucial for his or her own survival or for that of the household. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Bonded Labour due to Family Indebtedness<\/span>.<\/p>\n<p><strong>2. Adult unemployment and under-employment:<\/strong>\u00a0High prevalence of adult unemployment and under-employment often <span style=\"color: #ff0000;\">force children to work to support family<\/span>.<\/p>\n<p><strong>3. High prevalence of illiteracy and ignorance of parents:<\/strong>\u00a0Illiteracy and ignorance of the parents put children under the risk of inhuman exploitation.<\/p>\n<p><strong>4. Lack of access to quality education and skills training:<\/strong>\u00a0<span style=\"color: #ff0000;\">Deplorable quality of education<\/span> and <span style=\"color: #ff0000;\">lack of coverage of 15-18 year age group in compulsory education<\/span>, has led to increase in dropout rates and forced children into child labour.<\/p>\n<p><strong>5. Cultural factors: <\/strong>Children often take up family\u2019s traditional work from an early age, contributing to enhancement of Child labour. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">A Goldsmith\u2019s son taking to gold-smithery<\/span>, or a <span style=\"color: #ff0000;\">carpenter\u2019s child taking up carpentry from an early age<\/span>.<\/p>\n<p><strong>6. Social factors:<\/strong>\u00a0India\u2019s <span style=\"color: #ff0000;\">differentiated social structure<\/span> also <span style=\"color: #ff0000;\">contribute to child labour<\/span>. The majority of child labourers in India belong to the <span style=\"color: #ff0000;\">marginalised social groups<\/span> like <span style=\"color: #ff0000;\">SCs<\/span>, <span style=\"color: #ff0000;\">STs<\/span> and <span style=\"color: #ff0000;\">the Muslim religious minority<\/span>.<\/p>\n<p><strong>7. Epidemics and Disasters:<\/strong>\u00a0Natural disasters, conflicts, and pandemics <span style=\"color: #ff0000;\">increase the vulnerability of Children towards forced labour<\/span>, as they forced to work for survival and are often exploited by traffickers and perpetrators.<\/p>\n<h2><span style=\"text-decoration: underline;\"><span style=\"color: #000000; text-decoration: underline;\"><strong><a id=\"toc3\"><\/a>What is the impact of the prevalence of Child Labour in India?<\/strong><\/span><\/span><\/h2>\n<p><span style=\"color: #333333;\"><strong>1. Impedes Children from gaining skills and education:<\/strong>\u00a0Child labour <span style=\"color: #ff0000;\">impedes children from gaining the skills<\/span> and <span style=\"color: #ff0000;\">education<\/span> they need to have opportunities of decent work as an adult. This violates their right to life and liberty as provided by the constitution.<\/span><\/p>\n<p><span style=\"color: #333333;\"><strong>2. Health and Physical Risks:<\/strong>\u00a0<span style=\"color: #ff0000;\">Long working hours<\/span> and <span style=\"color: #ff0000;\">hazardous working conditions <\/span>adversely affects a child\u2019s physical &amp; mental health and impairs their intellectual, emotional and psychological development.<\/span><\/p>\n<p><strong>3. Negatively affects Human Capital Formation:<\/strong>\u00a0Child labour diminishes children&#8217;s ability to accumulate skills and knowledge, thereby <span style=\"color: #ff0000;\">affecting their future productivity and income<\/span>.<\/p>\n<p><strong>4. Perpetuation of poverty:<\/strong>\u00a0Child labour is both a cause and consequence of poverty. Household poverty forces children into the labour market to earn money. Obstacle to Socio-Economic Welfare of the country:<\/strong>\u00a0Presence of a large number of child labourers has long term effect on the economy and it is a serious obstacle to socio-economic welfare of a country. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Cancellation of trade pacts on account of human right abuses such as Child Labour<\/span>.<\/p>\n<p><strong>6. Global reputation:\u00a0<\/strong>An <span style=\"color: #ff0000;\">Australian Parliamentary committee<\/span> in its recent report has raised <span style=\"color: #ff0000;\">concerns over Child Labour in India<\/span>. According to the Parliamentary report, the mini trade deal (<span style=\"color: #ff0000;\">The Economic Cooperation and Trade Agreement<\/span> (<span style=\"color: #ff0000;\">ECTA<\/span>)) signed between India and Australia, does not recognise international labour rights and disregards environmental standards. This allows employers in industries like <span style=\"color: #ff0000;\">chemical mixing units<\/span>, <span style=\"color: #ff0000;\">cotton farms<\/span>, <span style=\"color: #ff0000;\">battery recycling units<\/span>, and <span style=\"color: #ff0000;\">brick kilns<\/span> etc. to employ adolescent labour.<\/li>\n<li>The <span style=\"color: #ff0000;\">amendment allows the child to be employed in \u201cfamily or family enterprises\u201d<\/span>. This promotes child labour in agrarian rural India, where poor families are trapped in intergenerational debt-bondage.<\/li>\n<\/ul>\n<p><strong>2. Definition of Child:<\/strong>\u00a0One of the biggest challenges in eradicating child labour is the confusion around the definition of a child, in terms of age, in various laws dealing with child labour. <strong>For ex-<\/strong> <span style=\"color: #ff0000;\">Conflicting age of Child provided in Juvenile Justice Act and Child Labour Act<\/span>.<\/p>\n<p><strong>3. Lack of proper identity documents: <\/strong>Child labourers often <span style=\"color: #ff0000;\">lack school registration certificates and birth certificates<\/span>, which, creates an easy loophole in the law to exploit. Also, lack of reporting of children of migrant workers working as labourers and domestic help, further aggravates the problem of Child Labour.<\/p>\n<p><strong>4. Weak enforcement of law and poor governance:<\/strong>\u00a0Weak enforcement of law, lack of adequate deterrence and corruption is a major hurdle in eradicating child labour.<\/p>\n<p><strong>5. Socio-Economic crisis:<\/strong>\u00a0The economic contraction and lockdowns lead to <span style=\"color: #ff0000;\">income reductions for enterprises and workers<span style=\"color: #333333;\">, promoting<\/span><\/span><span style=\"color: #333333;\">\u00a0<\/span>child labour.<\/p>\n<h2><span style=\"text-decoration: underline;\"><span style=\"color: #000000; text-decoration: underline;\"><strong><a id=\"toc6\"><\/a>What should be the Way Forward?<\/strong><\/span><\/span><\/h2>\n<p><strong>1. Uniformity in Indian Laws dealing with Child Labour:<\/strong>\u00a0We must aim to bring uniformity in existing Indian laws dealing with child labour. The laws must expand the definition of a child.\u00a0 We must also <span style=\"color: #ff0000;\">ensure free and compulsory education (RTE, Act, 2009) for children below 18 years<\/span>.<\/p>\n<p><strong>2. Police action in case of failure to register child labour:<\/strong>\u00a0The 52nd report of the Parliamentary Standing Committee on Labour has suggested incorporating provisions for taking action against the police <span style=\"color: #ff0000;\">for not registering FIRs in the CLPRA Act<\/span>,<span style=\"color: #ff0000;\"> similar to the Protection of Children from Sexual Offences Act, 2012<\/span>.<\/p>\n<p><strong>3. Social Protection Schemes:<\/strong>\u00a0There should be concerted effort towards social protection programmes and cash transfers to <span style=\"color: #ff0000;\">improve the economic situation of families<\/span> and to reduce the \u201cneed\u201d to send children to work.<\/p>\n<p><strong>4. District-level Funds and National Level Child Tracking Mechanism:<\/strong>\u00a0The 52nd report of the Parliamentary Standing Committee on Labour has <span style=\"color: #ff0000;\">recommended establishing a district-level fund and National Level Child Tracking Mechanism<\/span> for immediate relief and rehabilitation for child laborers.<\/p>\n<p><strong>5. Raise Awareness:<\/strong>\u00a0Government with the <span style=\"color: #ff0000;\">help of NGOs like Bachpan Bachao Andolan, ChildFund, CARE India, Talaash Association, Child Rights and You<\/span> should take adequate measures to raise awareness among families and communities. Parental literacy can also play an important role in ensuring that the rights of children are upheld.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #fae60a;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><strong>Case Study: VELPUR MODEL:<\/strong><\/p>\n<ul>\n<li>Velpur Mandal in Nizamabad district in erstwhile Andhra Pradesh (now Telangana), was once notorious for child labour.<\/li>\n<li>However, in 2001, a drive involving the community was started to ensure that all children in the age group 5 to 15 years went to school &amp; that no child would be engaged as labour in any form.<\/li>\n<li>In the beginning, the team consisting of highly motivated officials, faced resistance by the locals, but gradually they were able to persuade the locals which eventually not only cooperated with them but transformed their campaign into a movement.<\/li>\n<li>After a sustained campaign of 100 days, Velpur was declared to be a <strong>&#8220;child labour free mandal&#8221;<\/strong>.<\/li>\n<li>24 years later, there is 100% retention in school &amp; no child labour in the Mandal.<\/li>\n<li>Thus, the Mandal was able to shun child labour due to total control, commitment &amp; involvement of local community.<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Conclusion:<br \/>\n<\/strong>Child Labour is a<span style=\"color: #ff0000;\"> rampant problem in India<\/span>, despite a plethora of legislations to curb it. It is a <span style=\"color: #ff0000;\">humanitarian crisis<\/span> which <span style=\"color: #ff0000;\">tarnishes the international image of India<\/span> as well as<span style=\"color: #ff0000;\"> damages its trade prospects<\/span>.
