ET<\/figcaption><\/figure>\n<ul>\n<li>RUPPs are political parties registered with the Election Commission of India (ECI) <strong>under Section 29A of the Representation of the People Act, 1951<\/strong> but have <strong>not yet qualified as State or National Parties.<\/strong><\/li>\n<li><strong>Features<\/strong>\n<ul>\n<li>These are <strong>either newly-registered parties or<\/strong><\/li>\n<li>These are parties which <strong>have not secured enough percentage of votes<\/strong> in the <strong>Assembly or general election<\/strong> to become a <strong>State party <\/strong>or<\/li>\n<li>Those parties that have <strong>never contested elections<\/strong> after being registered.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Symbol: Common symbols<\/strong> are provided to RUPPs based upon an <strong>undertaking<\/strong> that they would put up <strong>\u201cat least 5% of total candidates with regard to said Legislative Assembly election of a State\u201d.<\/strong>\n<ul>\n<li>The symbols are provided under Provisions of <strong>Para 10B of the Election Symbols (Reservation &amp; Allotment) Order, 1968.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Conditions for RUPPS<\/strong>\n<ul>\n<li>They are required to maintain the <strong>details of individual donors<\/strong> who have donated <strong>above \u20b920,000 in a financial year <\/strong>and submit these details to the <strong>ECI every year<\/strong>.\n<ul>\n<li>As per <strong>Section 29C of the RP Act<\/strong>, failure to furnish these details will result in <strong>losing income tax exemption. <\/strong><\/li>\n<\/ul>\n<\/li>\n<li>The RUPPs are <strong>required to accept donations in excess of \u20b92000 only<\/strong> through <strong>cheque or bank transfers.<\/strong><\/li>\n<li>RUPPs are required to <strong>furnish audited accounts for the last three fiscal years.<\/strong><\/li>\n<li>They are mandated to <strong>submit expenditure reports<\/strong> for the <strong>two preceding elections<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Benefits:<\/strong> The RUPPs enjoy the following <strong>benefits<\/strong> \u2013\n<ul>\n<li><strong>tax exemption<\/strong> for donations received under Section 13A of the Income Tax Act, 1961<\/li>\n<li>a <strong>common symbol<\/strong> for contesting general elections to the Lok Sabha\/State Assemblies<\/li>\n<li>20 <strong>\u2018star campaigners<\/strong>\u2019 during election campaigns<\/li>\n<\/ul>\n<\/li>\n<li><strong>De-listing of RUPPS by ECI<\/strong>\n<ul>\n<li>\u2018<strong>Letter pad parties\u2019:<\/strong> As per ECI notification, there are <strong>more than 2,800 RUPPs<\/strong> in India as of May 2025.\n<ul>\n<li>However, <strong>only around 750<\/strong> of them contested the 2024 general elections.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Issue:<\/strong> The <strong>RP Act does not confer explicit powers on the ECI to de-register<\/strong> any political party if it fails to contest elections, conduct inner-party elections or lodge requisite returns.<\/li>\n<li>The <strong>Supreme Court<\/strong> in <strong>Indian National Congress versus Institute of Social Welfare &amp; Ors (2002)<\/strong> had held that the <strong>ECI does not have the power<\/strong> to de-register any political party under the RP Act.\n<ul>\n<li>It may <strong>de-register only under exceptional circumstances<\/strong> such as the registration being obtained by <strong>fraud<\/strong> or the political party <strong>ceasing to have allegiance<\/strong> to the Indian Constitution or if it is declared <strong>unlawful<\/strong> by the Government.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The ECI has initiated steps to de-list 345 Registered Unrecognised Political Parties (RUPPs) that have not contested elections in the last six years.
