{"id":34188,"date":"2018-10-30T16:13:55","date_gmt":"2018-10-30T10:43:55","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=34188"},"modified":"2018-10-30T16:13:55","modified_gmt":"2018-10-30T10:43:55","slug":"abandoned-cows-mp-panel-seeks-penalty","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/abandoned-cows-mp-panel-seeks-penalty\/","title":{"rendered":"Abandoned cows: MP panel seeks penalty"},"content":{"rendered":"<p><a href=\"http:\/\/indianexpress.com\/article\/india\/abandoned-cows-mp-panel-seeks-penalty-cattle-shivraj-singh-chouhan-4923049\/\"><span style=\"font-weight: 400;\">Abandoned cows: MP panel seeks penalty<\/span><\/a><\/p>\n<p><b>Context<\/b><\/p>\n<p><span style=\"font-weight: 400;\">A state government committee has recommended on anti \u2013 cow slaughter that the <\/span><b>existing law should be amended to include provisions to penalise owners who abandon their cattle.<\/b><\/p>\n<p><b>The new provision for stray cattle:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Madhya Pradesh <\/span><b>Gauvansh Vadh Pratishedh Adhiniyam<\/b><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">the state anti-cow slaughter law has stringent provisions to punish those involved in the slaughter and illegal transportation of cattle, but there are no measures to punish owners who abandon their cows on the streets or in nearby villages.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Madhya Pradesh, accounting for nearly <\/span><b>10.27 per cent of country\u2019s cattle population, <\/b><span style=\"font-weight: 400;\">has over the last few months struggled with the menace of <\/span><b>abandoned cattle<\/b><span style=\"font-weight: 400;\">, with reports that abandoned cows were raiding crops and causing accidents on highways.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">MP has nearly 1.96 crore cattle heads but there is no estimate of the stray cattle population.<\/span><\/li>\n<\/ul>\n<p><b>What will be the penalty?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Penalty will be introduced for owners who abandon their cows.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The penalty will be slapped even if a cow is killed in road accidents as it\u2019s proof that the owner has abandoned it.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The committee was looking at how to get stray cows off highways and city streets by next year.<\/span><\/li>\n<\/ul>\n<p><b>The committee<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Bureaucrats from the departments of <\/span><b>animal husbandry, cooperation, urban development and environment<\/b><span style=\"font-weight: 400;\"> are members of the committee, which was recently set up to suggest measures to conserve the cow.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The committee wants the nomenclature of the law changed to include \u201c<\/span><b>conservation.<\/b><span style=\"font-weight: 400;\">\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">District collectors are using drones to find out areas affected by stray cows. Only 604 of the 1,246 registered gaushals in the state were active and that owners of gaushalas \u201cwho lie about the number of cows they shelter\u201d will also be penalized.<\/span><\/li>\n<\/ul>\n<p><b>Other recommendations<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Sterilisation (castration) of bulls of nondescript breeds.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Creation of gothan (structures where cows can rest)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gau abhyaranya (cow sanctuaries)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Gau vanvyavihar (forest areas demarcated for cows); and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Freeing charnoi (grazing) land from encroachment.<\/span><\/li>\n<\/ul>\n<p><b>Prevention of Cruelty to Animals Act <\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Prevention of Cruelty to Animals Act is an Act of the Parliament of India enacted in 1960 to prevent the infliction of unnecessary pain or suffering on animals and to amend the laws relating to the prevention of cruelty to animals.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">As per the provisions of the law the government of India formed the Animal Welfare Board of India.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The act however makes a provision under heading \u201cSaving as respects manner of killing prescribed by religion\u201d. Nothing contained in this Act shall render it an offence to kill any animal in a manner required by the religion of any community.<\/span><\/li>\n<\/ul>\n<p><b>Constitutional Provisions for cow slaughter<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Prohibition of cow slaughter finds a place in the Constitution, but not as an enforceable fundamental right.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is included as a \u201cDirective Principle of State Policy\u201d, which is meant to guide the state in policymaking, but cannot be enforced in any court.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This Directive Principle (Article 48 of the Constitution) has excluded the question of religious sentiments.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Article 48 states: \u201cThe State shall endeavour to organize agriculture and animal husbandry on modern and scientific lines and shall, in particular, take steps for preserving and improving the breeds, and prohibiting the slaughter, of cows and calves and other milch and draught cattle\u201d.<\/span><\/li>\n<\/ul>\n<p><b>What has the Supreme Court said?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court has consistently said that rules that contravene or rewrite the parent law, in this case the 1960 Act, should be rendered invalid for arbitrariness and unreasonableness.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">However, the burden to disprove the presumption that these rules are constitutional and valid lies with the petitioner.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The petitioner has to prove that the government lacked legislative competence to make the subordinate legislation. That the rules are a violation of the guaranteed fundamental and constitutional rights.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The petitioner has to prove that there was a failure on the part of the Centre to conform to the 1960 Act and the rules are repugnant to the laws of the land. The court said: \u201cWhere a Rule is directly inconsistent with a mandatory provision of the statute, then of course the task of the court is simple and easy.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">But where the contention is that the inconsistency or non-conformity of the Rule is not with reference to any specific provision of the enabling Act, but with the object and scheme of the Parent Act, the court should proceed with caution before declaring invalidity\u201d.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Abandoned cows: MP panel seeks penalty Context A state government committee has recommended on anti \u2013 cow slaughter that the existing law should be amended to include provisions to penalise owners who abandon their cattle.
