{"id":342666,"date":"2025-07-11T16:16:41","date_gmt":"2025-07-11T10:46:41","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=342666"},"modified":"2025-07-11T16:16:41","modified_gmt":"2025-07-11T10:46:41","slug":"admiralty-jurisdiction-settlement-of-maritime-claims-act-2017","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/admiralty-jurisdiction-settlement-of-maritime-claims-act-2017\/","title":{"rendered":"Admiralty (Jurisdiction &amp; Settlement of Maritime Claims) Act, 2017"},"content":{"rendered":"<p><strong>News:<\/strong> The Kerala High Court has ordered the conditional \u201carrest\u201d of Liberian container ship MSC Akiteta II, after the Kerala government filed an admiralty suit.<\/p>\n<h2>About Admiralty (Jurisdiction &amp; Settlement of Maritime Claims) Act, 2017<\/h2>\n<figure id=\"attachment_342667\" aria-describedby=\"caption-attachment-342667\" style=\"width: 481px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\" wp-image-342667\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-ToI-3.png?resize=481%2C314&#038;ssl=1\" alt=\"\" width=\"481\" height=\"314\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-ToI-3.png?resize=300%2C196&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-ToI-3.png?w=514&amp;ssl=1 514w\" sizes=\"auto, (max-width: 481px) 100vw, 481px\" \/><figcaption id=\"caption-attachment-342667\" class=\"wp-caption-text\">Source &#8211; ToI<\/figcaption><\/figure>\n<ul>\n<li>The Act governs <strong>maritime disputes in India<\/strong>.<\/li>\n<li>Under the Act, <strong>admiralty suits can be filed for maritime claims<\/strong> such as damage to ships, ownership and agreement disputes, loss of life, wage issues, and <strong>environmental damage<\/strong>.\n<ul>\n<li><strong>Admiralty suit<\/strong> is a <strong>legal<\/strong> proceeding pertaining to <strong>maritime law and disputes<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>The 2017 law replaced the colonial-era <strong>Admiralty Court Act, 1861<\/strong>, and <strong>Colonial Courts of Admiralty Act, 1890.<\/strong>\n<ul>\n<li>The <strong>previous laws<\/strong> gave jurisdiction <strong>only to the High Courts of Bombay, Calcutta and Madras<\/strong>, as these were the <strong>only major ports in India earlier<\/strong>.<\/li>\n<li>Now, the HCs of <strong>Kerala, Karnataka, Odisha, Telangana and Andhra Pradesh<\/strong> also have jurisdiction over maritime disputes.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Court\u2019s jurisdiction:<\/strong> The jurisdiction of the courts extends <strong>up to the territorial waters<\/strong> of their respective jurisdictions.\n<ul>\n<li>The limit of territorial waters is <strong>up to 12 nautical miles<\/strong> from the nearest point of a low-water line along the coast, including the <strong>seabed, subsoil and airspace above<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Claims over environmental damages <\/strong>\n<ul>\n<li><strong>Section 4 of the Admiralty Act:<\/strong> This section states that the <strong>High Court may exercise jurisdiction<\/strong> to hear and determine any question on a maritime claim, against any vessel, arising out of damage caused by the vessel to the environment; measures taken to remove such damage; compensation for such damage etc.<\/li>\n<li><strong>Under the Merchant Shipping Act, 1958<\/strong>, <strong>ship owners<\/strong> are <strong>liable for oil pollution damage<\/strong> in the event of leaks.<\/li>\n<li><strong>Environment Protection Act, 1986<\/strong> empowers authorities to <strong>take action against polluters<\/strong>.<\/li>\n<li><strong>National Green Tribunal (NGT)<\/strong> can also be approached to seek environmental compensation.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The Kerala High Court has ordered the conditional \u201carrest\u201d of Liberian container ship MSC Akiteta II, after the Kerala government filed an admiralty suit.
