{"id":343114,"date":"2025-07-19T18:10:56","date_gmt":"2025-07-19T12:40:56","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=343114"},"modified":"2025-07-19T18:10:56","modified_gmt":"2025-07-19T12:40:56","slug":"inter-state-river-water-disputes-resolution-in-india","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/inter-state-river-water-disputes-resolution-in-india\/","title":{"rendered":"Inter-State River Water Disputes Resolution in India"},"content":{"rendered":"<p><strong>News:<\/strong> The Union government will form a high-level expert committee to address inter-state water issues between Telangana and Andhra Pradesh on Krishna and Godavari rivers.<\/p>\n<h2>About Inter-State River Water Disputes Resolution in India<\/h2>\n<figure id=\"attachment_343115\" aria-describedby=\"caption-attachment-343115\" style=\"width: 452px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\" wp-image-343115\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-TNIE.jpg?resize=452%2C265&#038;ssl=1\" alt=\"\" width=\"452\" height=\"265\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-TNIE.jpg?resize=300%2C176&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/07\/Source-TNIE.jpg?w=678&amp;ssl=1 678w\" sizes=\"auto, (max-width: 452px) 100vw, 452px\" \/><figcaption id=\"caption-attachment-343115\" class=\"wp-caption-text\">Source &#8211; TNIE<\/figcaption><\/figure>\n<ul>\n<li><strong>Constitutional and legal framework<\/strong>\n<ul>\n<li><strong>Article 262 of the Constitution:<\/strong> It empowers Parliament to legislate for the adjudication of disputes relating to waters of inter-state rivers or river valleys.\n<ul>\n<li>It also allows Parliament to bar the jurisdiction of the Supreme Court and other courts over such disputes.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Entry 56 of the Union List: <\/strong>Regulation and development of inter-State rivers and river valleys.<\/li>\n<li><strong>Inter-State River Water Disputes (ISRWD) Act, 1956:<\/strong> It serves as the chief statutory mechanism for resolving such disputes.\n<ul>\n<li>It provides for the establishment of Water Disputes Tribunals for the adjudication of disputes among states regarding the sharing of river waters.<\/li>\n<li><strong>Defined time limits:<\/strong> The <strong>Act<\/strong> was most recently <strong>amended in 2002<\/strong> to set defined time limits for tribunal formation and award.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Resolution mechanisms<\/strong>\n<ul>\n<li><strong>Negotiation and agreement:<\/strong> Initially, states are encouraged to resolve disputes through dialogue and mutual agreement.<\/li>\n<li><strong>Dispute Resolution Committee (DRC):<\/strong> When <strong>negotiations fail<\/strong>, the <strong>Central Government<\/strong> may constitute a Disputes Resolution Committee (DRC) comprising a chairperson, expert members, and representatives from the disputing states.\n<ul>\n<li>The DRC is tasked to reach an amicable settlement through negotiation, typically within one year (extendable by six months).<\/li>\n<\/ul>\n<\/li>\n<li><strong>Water Disputes Tribunal:<\/strong> If the <strong>DRC cannot resolve<\/strong> the issue, the matter is referred to a dedicated Water Disputes Tribunal.\n<ul>\n<li>The tribunal must be constituted within a year of the request and is expected to deliver its decision within three years (extendable by two more years).
