NH<\/figcaption><\/figure>\n<ul>\n<li>The <strong>Environment (Protection) Rules for Management of Contaminated Sites, 2025<\/strong> are framed by the Ministry of Environment, forest and climate change (<strong>MoEFCC<\/strong>) under the <strong>Environment (Protection) Act, 1986. <\/strong><\/li>\n<li>The rules create the <strong>country\u2019s first dedicated legal framework<\/strong> for <strong>identifying, remediating and monitoring contaminated sites<\/strong> that pose serious risks to human health and ecosystems.<\/li>\n<li><strong>Aim:<\/strong> They aim to <strong>tackle contamination in soil, sediment, and water<\/strong> caused by industrial discharge, hazardous waste dumping, and past neglect.<\/li>\n<li><strong>Objective:<\/strong> The objective is to <strong>prevent further environmental degradation<\/strong> while ensuring <strong>polluters are held accountable<\/strong> through a structured process involving scientific investigation, risk assessment and mandatory clean-up actions.<\/li>\n<\/ul>\n<p><strong>Key features <\/strong><\/p>\n<ul>\n<li><strong>Identification of sites:<\/strong> The framework mandates the <strong>identification and classification<\/strong> of sites as <strong>either suspected, potentially contaminated or confirmed<\/strong> &#8211; based on <strong>evidence<\/strong> from industrial activity, community complaints or historical waste records.<\/li>\n<li><strong>Tracking of sites:<\/strong> Once a <strong>site is flagged<\/strong>, a <strong>centralised online portal<\/strong>, to be developed by the central pollution control board (<strong>CPCB<\/strong>), will <strong>track its status<\/strong>, enabling transparent public access to information and regulatory oversight.<\/li>\n<li><strong>Public participation:<\/strong> <strong>State boards<\/strong> must seek <strong>comments from affected stakeholders<\/strong> within <strong>60<\/strong> days of <strong>listing a site as contaminated<\/strong> and must <strong>publish<\/strong> the final list in regional newspapers.<\/li>\n<li><strong>Responsibility:<\/strong> The Rules create a <strong>&#8216;responsible person&#8217; mechanism<\/strong>, holding individuals, companies, or entities <strong>accountable<\/strong> for environmental damage.\n<ul>\n<li>Such responsible <strong>parties must bear the full cost of remediation<\/strong> and are <strong>barred<\/strong> from transferring ownership or altering land use without prior approval during or after the clean-up.\n<ul>\n<li>If the polluter is found, these <strong>costs must be repaid within 3 months<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u2018Orphan sites\u2019:<\/strong> Where a <strong>responsible party cannot be identified<\/strong>, commonly referred to as &#8216;orphan sites&#8217;, the government may step in with <strong>financial support<\/strong> drawn from multiple sources, including the environment relief fund, penalties from environmental violations and central or state allocations.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Voluntary clean-ups:<\/strong> The rules also introduce provisions for voluntary clean-up, <strong>allowing private entities to remediate<\/strong> sites if they demonstrate technical expertise, financial capability and consent from landowners.<\/li>\n<li><strong>Monitoring<\/strong>\n<ul>\n<li>The Rules call for the formation of <strong>monitoring committees at both state and central levels<\/strong>, comprising experts, ministry officials and regulators.\n<ul>\n<li>These committees are tasked with supervising implementation, recommending additional actions where necessary, and submitting annual compliance reports to the central government.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Funding<\/strong>\n<ul>\n<li>The Rules adopt <strong>a tiered model <\/strong>for financial set-up \u2013\n<ul>\n<li><strong>Himalayan and Northeastern states<\/strong>, the Union government will bear 90% of the clean-up costs, with the states contributing 10%.<\/li>\n<li><strong>Other states<\/strong>, the Union government-state ratio will be 60:40.<\/li>\n<li><strong>Union Territories (UTs),<\/strong> the entire cost will be borne by the Union government.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Exceptions: <\/strong>The Rules<strong> e<\/strong>xclude sites contaminated by:\n<ul>\n<li>Radioactive waste (covered under Atomic Energy Act)<\/li>\n<li>Mining-related pollution<\/li>\n<li>Marine oil pollution<\/li>\n<li>Municipal solid waste dump sites (covered by separate legislation).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The Union environment ministry has notified the Environment Protection (Management of Contaminated Sites) Rules, 2025 for remediation of contaminated sites by those responsible for contamination.
