{"id":344477,"date":"2025-08-14T19:11:05","date_gmt":"2025-08-14T13:41:05","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=344477"},"modified":"2025-08-14T19:11:05","modified_gmt":"2025-08-14T13:41:05","slug":"community-forest-rights-cfrs","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/community-forest-rights-cfrs\/","title":{"rendered":"Community Forest Rights (CFRs)"},"content":{"rendered":"<p><strong>News: <\/strong>RTI reveals that thousands of forest rights titles have been reported missing from government records over the past 17 months in Chhattisgarh.<\/p>\n<h2>About Community Forest Rights (CFRs)<\/h2>\n<figure id=\"attachment_344478\" aria-describedby=\"caption-attachment-344478\" style=\"width: 398px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\" wp-image-344478\" src=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?resize=398%2C224&#038;ssl=1\" alt=\"\" width=\"398\" height=\"224\" srcset=\"https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?resize=300%2C169&amp;ssl=1 300w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?resize=1024%2C577&amp;ssl=1 1024w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?resize=768%2C433&amp;ssl=1 768w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?resize=1536%2C865&amp;ssl=1 1536w, https:\/\/i0.wp.com\/forumias.com\/blog\/wp-content\/uploads\/2025\/08\/Source-TH-2.jpg?w=1553&amp;ssl=1 1553w\" sizes=\"auto, (max-width: 398px) 100vw, 398px\" \/><figcaption id=\"caption-attachment-344478\" class=\"wp-caption-text\">Source &#8211; TH<\/figcaption><\/figure>\n<ul>\n<li>Community Forest Rights (CFRs) are <strong>collective rights<\/strong> that <strong>recognize and empower forest-dwelling communities<\/strong>, especially scheduled tribes (<strong>STs<\/strong>) and other traditional forest dwellers (OTFDs), to <strong>use, manage, conserve, and protect forest resources<\/strong> within their <strong>customary boundaries.<\/strong><\/li>\n<li><strong>Legal framework<\/strong>\n<ul>\n<li><strong>Enabling law:<\/strong> The CFRs are granted under the <strong>Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006<\/strong>, commonly called the <strong>Forest Rights Act (FRA), 2006.<\/strong><\/li>\n<li><strong>Provision:<\/strong> The <strong>Section 3(1)(i) of the FRA<\/strong> vests the right <strong>\u201cto protect, regenerate or conserve or manage any community forest resource which they have been traditionally protecting and conserving for sustainable use.\u201d <\/strong>\n<ul>\n<li>The<strong> Gram Sabhas<\/strong> (village assemblies) become the <strong>legal authority<\/strong> to govern these resources.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Definitions in law:<\/strong> \u2018<strong>Community Forest Resource\u2019<\/strong> means <strong>customary common forest land<\/strong> within <strong>traditional or customary boundaries<\/strong> of the village, including reserved\/protected forests, <strong>national parks<\/strong>, and sanctuaries to which the <strong>community had traditional access.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Features of CFRs<\/strong>\n<ul>\n<li>It allows <strong>individuals and communities<\/strong> to get various types of <strong>titles over forest areas<\/strong> which they live on, use for their livelihoods, or collect produce from.<\/li>\n<li>The titles are distributed after each application is cleared by <strong>gram sabhas, sub-divisional level committees, and district-level committees. <\/strong><\/li>\n<li>As per the FRA, <strong>once titles are granted<\/strong>, they are <strong>neither transferable nor alienable<\/strong> but can <strong>only be inherited<\/strong>.<\/li>\n<li>The law <strong>does provide<\/strong> for <strong>diversion<\/strong> in specific cases, where community facilities are being planned or for government projects but <strong>only<\/strong> with the <strong>consent<\/strong> of the Gram Sabhas concerned.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Significance<\/strong>\n<ul>\n<li>CFRs ensure <strong>sustainable livelihoods<\/strong> of the community.<\/li>\n<li>These rights give the <strong>authority to the Gram Sabha<\/strong> to adopt local traditional practices of forest conservation and management within the community forest resource boundary.<\/li>\n<li>These rights also <strong>underline the integral role<\/strong> that forest dwellers play in the sustainability of forests and in the conservation of biodiversity.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: RTI reveals that thousands of forest rights titles have been reported missing from government records over the past 17 months in Chhattisgarh.
