TH<\/figcaption><\/figure>\n<p><strong>Constitutional \u00a0and Legal Provisions<\/strong><\/p>\n<ul>\n<li>The <strong>Indian Constitution<\/strong> provides for <strong>nominated members<\/strong> in the houses of <strong>Parliament<\/strong> and <strong>State legislature<\/strong>.<\/li>\n<li><strong>Lok Sabha and State assemblies:<\/strong> The provision for nominating <strong>two Anglo-Indian members<\/strong> to the <strong>Lok Sabha<\/strong> and <strong>one Anglo<\/strong>&#8211;<strong>Indian<\/strong> member to <strong>State Legislative Assemblies<\/strong> was <strong>discontinued<\/strong> in <strong>2020<\/strong>.\n<ul>\n<li>In the <strong>six States with Legislative Councils<\/strong>, nearly <strong>one-sixth of the members are nominated<\/strong>.<\/li>\n<li>These members are nominated <strong>by the Governors<\/strong> on the <strong>advice<\/strong> of the States\u2019 Council of Ministers.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Rajya Sabha<\/strong>: The <strong>Rajya Sabha<\/strong> has <strong>12 nominated members<\/strong>.\n<ul>\n<li>These members are <strong>nominated by the President<\/strong> on the <strong>aid and advice<\/strong> of the Union Council of Ministers.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Union Territories with Assembly: <\/strong>The composition of the Legislative Assemblies of <strong>three Union Territories (UT)<\/strong> is governed by <strong>acts of Parliament<\/strong>.\n<ul>\n<li><strong>UT of Delhi: Section 3<\/strong> of the <strong>Government of National Capital Territory of Delhi Act,<\/strong> 1991 provides for <strong>70 elected members<\/strong> in the Delhi Assembly.\n<ul>\n<li>There are <strong>no nominated MLAs<\/strong> in the Delhi Assembly.<\/li>\n<\/ul>\n<\/li>\n<li><strong>UT of Puducherry:<\/strong> <strong>Section 3<\/strong> of the <strong>Government of Union Territories Act, 1963<\/strong> provides for <strong>30 elected members<\/strong> in the Legislative Assembly of Puducherry.\n<ul>\n<li>It also provides that the <strong>Union government may nominate up to three members<\/strong> to the Puducherry Assembly.<\/li>\n<\/ul>\n<\/li>\n<li><strong>UT of Jammu and Kashmir: Section 14 of the J&amp;K Reorganisation Act, 2019<\/strong> (as <strong>amended in 2023<\/strong>) provides for a <strong>total of 90 elected seats<\/strong> in the Legislative Assembly of J&amp;K.\n<ul>\n<li><strong>Sections 15, 15A and 15B<\/strong> provide that the <strong>LG<\/strong> may <strong>nominate<\/strong> a total of up to <strong>five members<\/strong> \u2014 <strong>two women, two Kashmiri migrants and one displaced person from Pakistan occupied Kashmir<\/strong> \u2014 to the J&amp;K Assembly.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Judicial Precedents in cases related to the procedure of nomination of members to assemblies of UTs<\/strong><\/p>\n<ul>\n<li><strong> Lakshminarayanan versus Union of India (2018) case:<\/strong> The case was related to the procedure for <strong>nomination of members to the Puducherry Assembly<\/strong>.\n<ul>\n<li>The court upheld the <strong>power of the Union government to nominate three members<\/strong> to the Assembly and that it <strong>need not be based on the advice<\/strong> of the UT\u2019s Council of Ministers.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Government of NCT of Delhi versus Union of India (2023) case:<\/strong> The Supreme Court had delved into the concept of <strong>\u2018triple chain of command\u2019<\/strong> that ensures <strong>democratic accountability<\/strong>.\n<ul>\n<li>As per this <strong>\u2018triple chain of command\u2019 concept<\/strong>, the <strong>civil servants are accountable to ministers<\/strong>; <strong>ministers are accountable to the legislature<\/strong>; and the <strong>legislature is accountable to the electorate. <\/strong><\/li>\n<li>It therefore held that the <strong>LG is bound by the aid and advice of the Council of Ministers<\/strong> in all matters <strong>except<\/strong> where the <strong>Delhi Assembly does not have legislative powers<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Government of India&#8217;s stand <\/strong><\/p>\n<ul>\n<li>The <strong>nomination<\/strong> of five members to <strong>J&amp;K Assembly was outside the realm of the business of the elected government<\/strong> of J&amp;K.<\/li>\n<li>Therefore, the <strong>Lieutenant Governor<\/strong> can <strong>nominate<\/strong> five members to the <strong>J&amp;K Assembly without &#8220;aid and advice&#8221;
