AajTak<\/figcaption><\/figure>\n<p><strong>Constitutional and Legal Provisions<\/strong><\/p>\n<ul>\n<li><strong>Article 324<\/strong> of the Constitution and the <strong>CEC and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023<\/strong> lay down provisions regarding the <strong>appointment, tenure, and removal of the CEC.<\/strong><\/li>\n<\/ul>\n<p><strong>Process of Appointment<\/strong><\/p>\n<ul>\n<li><strong>Appointed by:<\/strong> The <strong>CEC and Election Commissioners<\/strong> are appointed by<strong> the President<\/strong> of India.<\/li>\n<li><strong>Selection committee:<\/strong> They are appointed upon the <strong>recommendation<\/strong> from a <strong>three-member selection committee<\/strong> comprising the <strong>Prime Minister, the Leader of the Opposition (LoP) in the Lok Sabha, and one member of the Union Cabinet.<\/strong><\/li>\n<li><strong>Conditions<\/strong>\n<ul>\n<li>Those appointed <strong>should have previously held secretary-level positions<\/strong> in the Government.<\/li>\n<li>They should be <strong>\u201cpersons of integrity<\/strong>, who have <strong>knowledge<\/strong> of and <strong>experience<\/strong> in <strong>management and conduct of elections.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Tenure: <\/strong>The appointments are made for a <strong>tenure of six years or until the age of 65 years<\/strong>, whichever comes first.<\/li>\n<li><strong>Service conditions:<\/strong> The <strong>CEC<\/strong> enjoys the <strong>same services and monetary benefits<\/strong> that are extended to justices of the <strong>Supreme Court<\/strong>.<\/li>\n<li><strong>Immunity:<\/strong> <strong>Clause 16<\/strong> of the <strong>2023 Act<\/strong> grants <strong>immunity to the CEC and ECs<\/strong> from <strong>any legal action for decisions taken while in office.<\/strong><\/li>\n<li><strong>Resignation:<\/strong> According to <strong>Clause 11(1) of the Act,<\/strong> the <strong>CEC or an EC<\/strong> can, at any time, by <strong>writing<\/strong> under his hand addressed to the <strong>President<\/strong>, resign from his office.<\/li>\n<\/ul>\n<p><strong>Process of Removal<\/strong><\/p>\n<ul>\n<li><strong>Constitutional and legal provision: Article 324(5)<\/strong> of the Constitution states that the <strong>CEC can be removed<\/strong> from office only in like <strong><a href=\"https:\/\/forumias.com\/blog\/impeachment-of-judges-explained-pointwise\/\">manner and on the like grounds as a Judge of the Supreme Court.<\/a><\/strong>\n<ul>\n<li>This framing can also be found in <strong>Section 11(2) of the 2023 Act.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>Any <strong>other Election Commissioner or a Regional Commissioner<\/strong> shall <strong>not<\/strong> be removed from office <strong>except on the recommendation of the Chief Election Commissioner<\/strong>.<\/li>\n<li><strong>Grounds of removal:<\/strong> The removal can only be on the ground of <strong>proved misbehavior or incapacity.<\/strong>\n<ul>\n<li><strong>Misbehaviour<\/strong> can comprise any corrupt practices or abuse of office.<\/li>\n<li><strong>Incapacity<\/strong> refers to a situation where the officer is unable to perform her duties.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: The opposition parties threaten the impeachment of Chief Election Commissioner (CEC) and action against the two election commissioners.
