Comment.<\/b><\/p>\n<p><b>Answer:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Indo-Pacific is the geographical connotation of the area which covers the Eastern Coast of Africa through Indian Ocean and Western Pacific Ocean.<\/span><\/p>\n<p><b>Importance of Indo &#8211; Pacific:<\/b><\/p>\n<p><b>Geo strategic:<\/b><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">a) US\u2019 Rebalance to Asia highlights the importance of the \u201cIndo-Pacific\u201d concept.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">b) The region consists of many of the world\u2019s vital choke points for global commerce, including the Straits of Malacca which is very critical for the growth of world economy.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">c) The boom in port construction has heightened the strategic significance of the Indo-Pacific and is likely to generate greater commercial traffic and greater strategic competition.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">d) Rising China is a key factor in the Indo-Pacific. Its issues with almost all the neighbouring nations points to the aggressive nature of its growth.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">e) The security environment is complicated by maritime boundary disputes in the SCS, disagreement over territorial waters in the Bay of Bengal and the emergence of non-traditional security challenges such as piracy, drug and human trafficking, terrorism and climate change. <\/span><\/p>\n<p><b>Economic:<\/b><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">a) The global economic power shift from the West to East (Asia).<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">b) It is rich in natural resources, especially hydrocarbons which fuel the industrial engines of the world\u2019s economies.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">c) It has emerged as a centre of international trade and investments. It embodies a large market defined by nearly half of the world\u2019s population.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">d) The region\u2019s growing economy and trade has created greater scope for regional economic integration.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Q.2) Examine the constitutional relation between the president and Prime Minister of India.<\/b><\/p>\n<p><b>Answer:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Constitution of India provided for a parliamentary form of government. So President has been made only a nominal executive; real executive being CoM headed by PM. President has to exercise his powers and functions with the aid and advise of CoM headed by PM.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Articles 53, 74 and 75 explain the constitutional power of president:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Executive power of Union shall be vested in President and shall be exercised by him either directly or through officers subordinate to him in accordance with this Constitution (Art 53).<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">There shall be CoM with PM at the head to aid and advise President who \u2018shall\u2019 in the exercise of his functions act in accordance with such advice (Article 74).<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">CoM shall be collectively responsible to LS(Article 75).<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">42nd Constitutional Amendment made President bound by the advice of CoM headed by PM. SC ruled that the power of Parliament to amend the Constitution under Article 368 also includes the \u00a0power to amend Fundamental Rights. The word \u2018law\u2019 in Article 13 includes only ordinary laws and not the constitutional amendment acts.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Golak Nath case &#8211; SC ruled that the FRs are given a \u2018transcendental and immutable\u2019 position and Parliament cannot abridge or take away any of these rights. A constitutional amendment act is also a law within the meaning of Article 13.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Parliament enacted the 24th Amendment Act (1971) which amended Articles 13 and 368. Parliament has the power to abridge or take away any of the Fundamental Rights under Article \u00a0368 and it will not be considered a law under Article 13.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Kesavananda Bharati case &#8211; upheld the validity of the 24th Amendment Act and stated that Parliament is empowered to abridge or take away any of the Fundamental Rights. It \u00a0also laid down \u2018basic structure\u2019 doctrine. It said that the constituent power of Parliament under Article 368 does not enable it to alter the \u2018basic structure\u2019 of the Constitution.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">42nd Amendment Act &#8211; amended Article 368 and declared that there is no limitation on the constituent power of Parliament and no amendment can be questioned in any court on any ground including contravention of Fundamental Rights.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Minerva Mills case &#8211; invalidated this provision as it excluded judicial review which is a \u2018basic feature\u2019 of the Constitution.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><b>Q.4) What is zero budget natural farming?
