Context<\/strong>: On August 25<\/strong>, the Supreme Court asked the Union government to draft social-media rules, citing commercialised speech<\/strong> that may hurt vulnerable groups. Justices Surya Kant<\/strong> and Joymalya Bagchi<\/strong> sought consultation with the National Broadcasters and Digital Association<\/strong> after a disability group flagged derogatory comedy content.<\/p>\n

Is there a regulatory vacuum requiring new guidelines?<\/strong><\/h2>\n

  1. Existing legal tools were already invoked: <\/strong>FIRs in Maharashtra<\/strong> and Assam<\/strong> cited the Bharatiya Nyaya Sanhita<\/strong> and the IT Act, 2000<\/strong> over a YouTube skit, \u201cIndia\u2019s Got Latent.\u201d<\/strong> This formed the basis for the Court\u2019s consideration of the complaint against named comedians.<\/li>\n
  2. The IT Act enables takedowns but lacks transparency: <\/strong>Courts or the executive can order removals. In practice, actions often occur secretly and with weak adherence to natural justice. This opacity, not absence of law, is the core concern raised.<\/li>\n

    2. Courts may act to do \u201ccomplete justice.\u201d: <\/strong>Concerns about participation and dignity of persons with disabilities are legitimate. The Court can consider wider social effects of online speech within its constitutional mandate.<\/li>\n
    3. Limits must be lawful and proportionate:<\/strong> Any restriction needs a duly enacted law and must pass proportionality. In Subramanian Swamy v. Union of India<\/em> (2016), criminal defamation was upheld, recognising dignity to sustain that remedy. Yet elevating dignity alone invites expansive censorship.<\/li>\n<\/ol>\n

      Would new rules chill speech deemed unpalatable?<\/strong><\/h2>\n

      1. Independent \u201cdignity\u201d tests would deter artists: <\/strong>When morality or defamation overlaps with dignity, limits may apply. But dignity as a stand-alone basis is not defensible and would chill comedians, satirists, and others.<\/li>\n
      2. Uncomfortable speech has constitutional value:<\/strong> Literature and stand-up often confront society. The Court has protected speech that offends or disturbs; a March order quashed a criminal case against a poem by a politician, reaffirming Article 19(1)(a).<\/li>\n
      3. Regulatory overreach risks mass censorship: <\/strong>Reviving the Broadcasting Services (Regulation) Bill could place independent creators under scrutiny. If \u201csocial value\u201d is majoritarian, inconvenient voices may be suppressed.<\/li>\n<\/ol>\n

        2. Livelihood does not dilute protection: <\/strong>A comedian must earn to perform; profit motive alone cannot justify regulation of speech.<\/li>\n
        3. Jurisprudence covers commercial speech, but creators\u2019 speech is not merely commercial: <\/strong>Courts have treated commercial speech as protected. Comedians, journalists, and satirists are not traditionally categorised as commercial speakers.<\/li>\n<\/ol>\n

          How should institutions proceed, and what safeguards are vital?<\/strong><\/h2>\n
            \n
          1. Polyvocality does not erase precedent: <\/strong>As a court of record, the Supreme Court follows earlier law; even with new facts, the essence of precedent endures.<\/li>\n
          2. Court-mandated rule-making raises constitutional hurdles:<\/strong> Directing the executive to frame regulations confers ordinary and reinforced legitimacy, blurring boundaries and making later challenges harder.<\/li>\n
          3. Coordinate Bench conflicts require referral:<\/strong> When a Bench of equal strength departs from another, discipline demands reference to a larger Bench.<\/li>\n
          4. Safeguards must ensure transparency and inclusion:<\/strong> Build strong review mechanisms and a free-speech ethos in enforcement. Consult all affected stakeholders, not only those favouring restrictions. Address opacity in Section 69A\/Blocking Rules processes, including notice to those whose content is removed.<\/li>\n<\/ol>\n
