District Magistrates and Police Commissioners may issue detention orders <strong>only when expressly authorized by the respective government<\/strong>, and they act <strong>within the scope<\/strong> of that authorization.\n<ul>\n<li>A detention order operates like a warrant; custody conditions may be prescribed and transfer across states is permitted.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Grounds for detention:<\/strong> Detention may be ordered to prevent acts prejudicial to the <strong>defence of India<\/strong>, <strong>relations with foreign powers<\/strong>, the <strong>security of India<\/strong>, the <strong>maintenance of public order<\/strong>, or the <strong>maintenance of essential supplies and services<\/strong>.<\/li>\n<li><strong>Detention period:<\/strong> Preventive detention may extend <strong>up to 12 months<\/strong>. It can be revoked earlier, and any extension requires <strong>fresh material <\/strong>showing that the threat persists.<\/li>\n<li><strong>Detainee Rights: <\/strong>Authorities must communicate the <strong>grounds of detention within 5 days<\/strong> (extendable to <strong>15 days<\/strong>).\n<ul>\n<li>The detainee has the <strong>right to make a representation<\/strong> to the government.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Advisory Boards:<\/strong> An Advisory Board of<strong> High Court judges<\/strong> must <strong>review <\/strong>the case<strong> within three weeks<\/strong> of detention and order<strong> release <\/strong>if there is <strong>no sufficient cause<\/strong>.\n<ul>\n<li>Advisory Board consists of<strong> three members <\/strong>who are qualified to be <strong>High Court judges<\/strong>.<\/li>\n<li>Central and State Governments may constitute <strong>one or more Advisory Boards<\/strong> as needed.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Limits and procedural restrictions :<\/strong> The detainee <strong>has no right to legal representation before the Advisory Board<\/strong>, and the government <strong>may withhold facts in public interest<\/strong>.<\/li>\n<li><strong>Temporary release:<\/strong> The appropriate government may <strong>temporarily release<\/strong> a detainee for a specified period <strong>with or without conditions<\/strong>, and may <strong>cancel such release<\/strong> at any time.<\/li>\n<li><strong>Protection of good-faith action:<\/strong> <strong>No suit, prosecution, or other legal proceeding<\/strong> lies against authorities for <strong>anything done or intended to be done in good faith under the Act.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Historical context<\/strong><\/p>\n<ul>\n<li>Preventive detention in India traces back to <strong>colonial-era measures<\/strong> that permitted detention without trial, including <strong>Bengal Regulation III (1818)<\/strong> and the <strong>Rowlatt Acts (1919)<\/strong>.<\/li>\n<li>After Independence, Parliament enacted the <strong>Preventive Detention Act, 1950<\/strong>, followed by <strong>Maintenance of Internal Security Act (MISA), (1971)<\/strong>, which was <strong>repealed in 1978<\/strong>.<\/li>\n<li>Two years later, the framework culminated in the <strong>National Security Act (NSA)<\/strong>.\n<ul>\n<li>The NSA was <strong>promulgated on September 23, 1980<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: Sonam Wangchuk\u2019s preventive detention under the National Security Act (NSA) has renewed attention on this stringent law that is used against perceived threats to public order and national security.
