On <strong>June 30<\/strong>, the <strong>Sigachi Industries chemical factory explosion in Telangana<\/strong> killed <strong>40 workers<\/strong>, followed by accidents in <strong>Tamil Nadu<\/strong> and <strong>Chennai<\/strong>, claiming several more lives.<\/p>\n<p>The <strong>British Safety Council<\/strong> estimates that <strong>one in four fatal workplace accidents worldwide occur in India<\/strong> \u2014 a figure that underestimates the problem due to widespread underreporting, especially among informal and contract labour.<\/p>\n<h2><strong>Why Do Workplace Accidents Occur?<\/strong><\/h2>\n<ol>\n<li>Accidents are <strong>not inevitable<\/strong> but result from <strong>employer negligence<\/strong> and weak enforcement of safety laws.<\/li>\n<li><strong>Failures include:<\/strong>\n<ol style=\"list-style-type: lower-alpha;\">\n<li>Poor workplace design and outdated machinery.<\/li>\n<li>Inadequate maintenance, non-functional alarms, and a lack of evacuation systems.<\/li>\n<li>Ignored worker complaints and dismissed safety concerns.<\/li>\n<\/ol>\n<\/li>\n<li>The Telangana incident revealed systemic neglect \u2014 outdated reactors, ignored warnings, and absence of safety supervision.<\/li>\n<\/ol>\n<h2><strong>International Labour <\/strong><strong>Organisation (ILO) Stand<\/strong><\/h2>\n<ol>\n<li>The <strong>ILO<\/strong> notes that industrial accidents are rarely random \u2014 they stem from <strong>management failures<\/strong> in maintaining safety standards.<\/li>\n<li>It criticises employers for blaming \u201chuman error\u201d instead of addressing systemic negligence, long working hours, and unsafe environments.<\/li>\n<li>The ILO stresses <strong>preventive responsibility<\/strong>, not post-disaster compensation.<\/li>\n<\/ol>\n<h2><strong>Legal Framework in India<\/strong><\/h2>\n<ul>\n<li><strong>Factories Act, 1948:<\/strong> First legislation mandating safe and healthy working conditions.<\/li>\n<li><strong>Occupational Safety, Health and Working Conditions (OSHWC) Code, 2020:<\/strong> Consolidates 13 labour laws (including Factories Act, Mines Act, Contract Labour Act).<\/li>\n<li>The OSHWC Code, though currently <strong>in abeyance<\/strong>, aims to modernise health and safety norms.<\/li>\n<li>However, <strong>implementation and accountability remain weak<\/strong>, with most provisions unenforced and employers rarely penalised.<\/li>\n<\/ul>\n<h2><strong>Challenges in Protecting Workers\u2019 Rights<\/strong><\/h2>\n<ol>\n<li><strong>Systematic Dilution of Labour Laws: <\/strong>Since the <strong>1990s<\/strong>, labour protections have been weakened in the name of <strong>\u201cflexibility\u201d<\/strong> and <strong>\u201cEase of Doing Business.\u201d <\/strong>Governments reduced inspections and rebranded regulations as <strong>\u201cobstacles to business.\u201d<\/strong><\/li>\n<li><strong>Self-Certification and Weak Oversight: <\/strong>States like Maharashtra allowed <strong>self-certification<\/strong> of compliance, reducing government monitoring. Violations often go unchecked, and accountability is minimal.<\/li>\n<li><strong>Informalization of Labour: <\/strong>A large share of India\u2019s workforce is <strong>informal or contract-based<\/strong>, outside legal protection frameworks. These workers face unsafe environments, irregular pay, and no compensation.<\/li>\n<li><strong>Charity over Justice: <\/strong>Governments and companies issue <strong>ex gratia payments<\/strong> instead of enforcing legal compensation, turning accountability into tokenism.<\/li>\n<li><strong>Profit-Driven Work Culture: <\/strong>India\u2019s business environment prioritizes <strong>productivity and cost efficiency<\/strong> over worker safety. During the <strong>COVID-19 pandemic<\/strong>, working hours were extended, and temporary relaxations in labour laws became permanent.<\/li>\n<li><strong>Weak Institutional Mechanisms: <\/strong>Insufficient factory inspections, lack of data on workplace accidents, and poor inter-agency coordination impede enforcement.<\/li>\n<\/ol>\n<h2><strong>Way Forward<\/strong><\/h2>\n<ol>\n<li><strong>Strengthen Enforcement:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Reinstate and empower the <strong>labour inspectorate<\/strong> with digital monitoring and surprise inspections.<\/li>\n<li>Enforce accountability through criminal and civil penalties for negligence.<\/li>\n<\/ul>\n<ol>\n<li><strong>Implement OSHWC Code Effectively: <\/strong>Operationalise the <strong>Occupational Safety Code, 2020,<\/strong> with clear rules and real-time reporting mechanisms.<\/li>\n<li><strong>ILO Compliance: <\/strong>Align national labour policies with <strong>ILO conventions<\/strong> on workplace safety and decent work.<\/li>\n<li><strong>Empower Workers and Unions:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Encourage <strong>collective bargaining<\/strong>, representation, and whistleblower protection.<\/li>\n<li>Involve workers in safety audits and risk assessments.<\/li>\n<\/ul>\n<ol>\n<li><strong>Transparency and Data:n <\/strong>Mandate reporting of all industrial accidents and maintain a <strong>national workplace safety registry<\/strong>.<\/li>\n<li><strong>Shift in Business Culture:<\/strong><\/li>\n<\/ol>\n<ul>\n<li>Promote a <strong>\u201csafety-first\u201d<\/strong> industrial culture that views protection not as a cost but as an investment.<\/li>\n<li>Encourage <strong>ESG (Environmental, Social, Governance)<\/strong> compliance and social audits.<\/li>\n<\/ul>\n<ol>\n<li><strong>Judicial and Administrative Accountability: <\/strong>Fast-track compensation cases and enforce employer liability to deter future negligence.<\/li>\n<\/ol>\n<p><strong>Conclusion: <\/strong>India\u2019s industrial growth cannot come at the cost of human safety.
