ET<\/figcaption><\/figure>\n<ul>\n<li><strong>Constitutional provision: Article 233<\/strong> of the Indian Constitution deals with the <strong>appointment of District Judges<\/strong>.<\/li>\n<\/ul>\n<table style=\"border-collapse: collapse;width: 100%;height: 297px\">\n<tbody>\n<tr style=\"height: 113px\">\n<td style=\"width: 17.8279%;height: 113px\">\n<p data-start=\"163\" data-end=\"220\"><strong data-start=\"168\" data-end=\"220\">Qualifications\u00a0<\/strong><\/p>\n<\/td>\n<td style=\"width: 82.1721%;height: 113px\">\n<ul>\n<li data-start=\"224\" data-end=\"312\">The person must have practiced as an <strong data-start=\"261\" data-end=\"309\">advocate or pleader for at least seven years<\/strong>.<\/li>\n<li data-start=\"316\" data-end=\"382\">The person <strong data-start=\"327\" data-end=\"379\">must not be in government or Union\/State service<\/strong>.<\/li>\n<li data-start=\"386\" data-end=\"455\">The person <strong data-start=\"397\" data-end=\"438\">must be recommended by the High Court<\/strong> for appointment.<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr style=\"height: 184px\">\n<td style=\"width: 17.8279%;height: 184px\">\n<p data-start=\"462\" data-end=\"496\"><strong data-start=\"467\" data-end=\"496\">Procedure for Appointment<\/strong><\/p>\n<\/td>\n<td style=\"width: 82.1721%;height: 184px\">\n<ul>\n<li data-start=\"500\" data-end=\"690\">Under <strong data-start=\"506\" data-end=\"521\">Article 233<\/strong>, the appointment of District Judges is made <strong data-start=\"566\" data-end=\"612\">after consulting the Governor of the State<\/strong> and the <strong data-start=\"621\" data-end=\"649\">Judges of the High Court<\/strong> exercising jurisdiction in that State.<\/li>\n<li data-start=\"811\" data-end=\"982\"><strong data-start=\"811\" data-end=\"828\">Article 233-A<\/strong> validates appointments of District Judges made before the <strong data-start=\"887\" data-end=\"920\">Twentieth Amendment Act, 1966<\/strong>, even if not strictly in accordance with Articles 233 or 235.<\/li>\n<li><strong data-start=\"694\" data-end=\"709\">Article 235<\/strong> gives the High Courts <strong data-start=\"732\" data-end=\"769\">control over the judicial service<\/strong> in district and subordinate courts.<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2>Supreme Court Judgement<\/h2>\n<ul>\n<li>The Court held that <strong>judicial officers<\/strong> who had <strong>seven years of experience at the Bar before joining judicial service<\/strong> are <strong>eligible<\/strong> for appointment as <strong>District Judges<\/strong> under <strong>Article 233 of the Constitution<\/strong>.<\/li>\n<li><strong>Earlier Restriction: <\/strong>Previously, only <strong>practising advocates with seven years\u2019 experience<\/strong> were eligible for direct recruitment as District Judges.\n<ul>\n<li>Judicial officers who had prior legal practice but later joined service were <strong>excluded<\/strong>, creating stagnation and lowering motivation in the subordinate judiciary.<\/li>\n<\/ul>\n<\/li>\n<li>The Bench noted that <strong>Article 233(2)<\/strong> does <strong>not prohibit<\/strong> those already in judicial service from being considered for appointment as District Judges if they meet the overall experience requirement.<\/li>\n<li><strong>Eligibility Clarified:<\/strong>\n<ul>\n<li>A person having a <strong>combined experience of seven years or more<\/strong> as an <strong>advocate and\/or judicial officer<\/strong> can now be <strong>considered for appointment<\/strong> as <strong>District Judge or Additional District Judge<\/strong> under Article 233.<\/li>\n<li><strong>Minimum Age Requirement: <\/strong>The <strong>minimum age<\/strong> for appointment as a <strong>District or Additional District Judge<\/strong> (for both advocates and judicial officers) is fixed at <strong>35 years<\/strong> as on the <strong>date of application<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: Recently, the Supreme Court delivered a landmark judgment regarding the appointment of District Judges.
