{"id":34783,"date":"2018-10-31T13:18:03","date_gmt":"2018-10-31T07:48:03","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=34783"},"modified":"2018-10-31T13:18:03","modified_gmt":"2018-10-31T07:48:03","slug":"can-india-protect-rohingya-sc-asks-govt","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/can-india-protect-rohingya-sc-asks-govt\/","title":{"rendered":"Can India protect Rohingya, SC asks govt:\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/can-india-protect-rohingya-sc-asks-govt\/article19793562.ece\"><span style=\"font-weight: 400;\">Can India protect Rohingya, SC asks govt<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p><b>Context<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Chief Justice of India Dipak Misra, who leads the three-judge Bench rejects Centre\u2019s stance that decision to deport the community is outside the domain of the Supreme Court<\/span><\/p>\n<p><b>Government stand on rohingya\u2019s refugee<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">On \u00a0August 8, 2017 center communicated to all the States to identify Rohingya and aid in their deportation.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The government\u2019s claims that the Rohingya refugees will eat into the resources meant for citizens<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Government is concerned on whether the country can sustain such an influx of refugees.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> The Centre claims that the Rohingya community is a threat to national security and easy prey for radicalisation. <\/span><\/li>\n<\/ul>\n<p><b>Argument in \u00a0favour of \u00a0rohingya\u2019s refugee<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The obligation to grant asylum was universal. \u201cThe Government of India has constantly made efforts to substantiate, enhance the rights of refugees.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The fundamental right to life enshrined in Article 21 protects all \u201cpersons,\u201d including refugees who fled persecution in their native countries.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Government of India has constantly made efforts to substantiate, enhance the rights of refugees.
