The <strong>Shram Shakti Niti 2025<\/strong> recognises the vital role of MSMEs in generating employment and driving production. However, India\u2019s consolidated labour codes, while progressive, often impose <strong>uniform compliance burdens<\/strong> unsuitable for small firms. A <strong>tailored Employment Relations (ER) Code<\/strong> has been proposed to bridge this gap \u2014 bringing MSMEs under the fold of protection while maintaining operational flexibility and proportional compliance.<\/p>\n<h2><strong>Context and Rationale for Reform<\/strong><\/h2>\n<ol>\n<li>India consolidated nearly <strong>50 labour laws<\/strong> into four codes \u2014 on <strong>Wages<\/strong>, <strong>Social Security<\/strong>, <strong>Industrial Relations<\/strong>, and <strong>Occupational Safety and Health (OSH)<\/strong>.<\/li>\n<li>These reforms primarily address large enterprises with robust administrative systems.<\/li>\n<li>MSMEs, on the other hand, rely on <strong>trust-based, informal relationships<\/strong> and operate with limited resources and administrative capacity.<\/li>\n<li>Applying identical compliance procedures to both small and large enterprises leads to a <strong>structural mismatch<\/strong> that discourages formalisation.<\/li>\n<li>Thus, the next logical step is a <strong>dedicated ER Code<\/strong> for small establishments, balancing <strong>protection, flexibility, and practicality<\/strong>.<\/li>\n<\/ol>\n<h2><strong>Key Features of the Proposed Employment Relations (ER) Code<\/strong><\/h2>\n<ol>\n<li><strong>Applicability: <\/strong>Designed for enterprises employing <strong>up to 50 workers<\/strong>, easing compliance requirements.<\/li>\n<li><strong>Work Councils: <\/strong>Establishment-level councils comprising employer and employee representatives.
