The approach prefers <strong>agile, sector-specific regulation<\/strong> over an immediate new AI law. It proposes an <strong>India-specific risk framework<\/strong>, <strong>AI incident database<\/strong>, <strong>content authentication<\/strong> for deepfakes, and <strong>techno-legal safeguards<\/strong> embedded in system design, ahead of the <strong>India\u2013AI Impact Summit 2026<\/strong>.<\/p>\n<h2><strong>Need for India AI Governance Guidelines<\/strong><\/h2>\n<ol>\n<li><strong> Harnessing AI while limiting harm:<\/strong> India aims to <strong>use AI for inclusive development and competitiveness<\/strong> while managing risks to people and society. Use is expanding fast, including <strong>large language models<\/strong>, demanding clarity on responsibility, safety research, and risk classification.<\/li>\n<li><strong> Avoiding premature over-regulation:<\/strong>The stance is to <strong>not tighten rules immediately<\/strong>. The goal is to let an <strong>innovation economy<\/strong> flourish while preparing guardrails such as <strong>risk assessment<\/strong>, <strong>voluntary frameworks<\/strong>, and <strong>grievance mechanisms<\/strong>.<\/li>\n<li><strong> Deepfake and content authenticity challenge: <\/strong>Synthetically generated images, videos, and audio require content authentication. Draft amendments to IT Rules propose declarations by uploaders, platform verification, and visible labels; non-compliant platforms risk losing safe-harbour.<\/li>\n<li><strong> Public-sector exposure risks: <\/strong>There are <strong>privacy and inference risks<\/strong> when officials use AI systems. At scale, prompts may reveal priorities or patterns. There is debate on <strong>protecting official systems from foreign AI services<\/strong> and on potential uses of <strong>anonymised mass data <\/strong>by global firms.<\/li>\n<\/ol>\n<h2><strong>Guiding Principle of AI Governance Guidelines<\/strong><\/h2>\n<ol>\n<li><strong> \u201cDo No Harm\u201d with flexible sandboxes:<\/strong> The central ethic is <strong>\u201cDo No Harm.\u201d<\/strong> Innovation should occur in <strong>sandboxes<\/strong>, with <strong>risk mitigation<\/strong> built into a <strong>flexible, adaptive<\/strong> governance system.<\/li>\n<li><strong> People-centric and law-first approach: <\/strong>Policy remains <strong>human-centric<\/strong>. It relies on <strong>existing laws<\/strong>\u2014notably the <strong>IT Act<\/strong> and the <strong>Digital Personal Data Protection Act<\/strong>\u2014and fills <strong>gaps through targeted amendments<\/strong> rather than creating a standalone AI statute now.<\/li>\n<li><strong> Seven guiding principles : Seven guiding principles or sutras<\/strong> have been\u00a0 adapted\u00a0 from\u00a0 the\u00a0 <strong>RBI\u2019s\u00a0 FREE-AI\u00a0 Committee\u00a0 report<\/strong>\u00a0 to guide the overall approach. These principles have been adapted for application across sectors and aligned with national priorities.<\/li>\n<\/ol>\n<p><strong>Trust is the Foundation: <\/strong>Without trust, innovation and adoption will stagnate.<\/p>\n<p><strong>People First: <\/strong>Human-centric design, human oversight, and human empowerment.<\/p>\n<p><strong>Innovation over Restraint:<\/strong> All other things being equal, responsible innovation should be prioritised over cautionary restraint.<\/p>\n<p><strong>Fairness &amp; Equity:<\/strong> Promote inclusive development and avoid discrimination.<\/p>\n<p><strong>Accountability:<\/strong> Clear allocation of responsibility and enforcement of regulations.<\/p>\n<p><strong>Understandable by Design: <\/strong>Provide disclosures and explanations that can be understood by the intended user and regulators.<\/p>\n<p><strong>Safety, Resilience &amp; Sustainability: <\/strong>Safe, secure, and robust systems that are able to withstand systemic shocks and are environmentally sustainable.<\/p>\n<h2><strong>Key Issues in AI Governance in India<\/strong><\/h2>\n<p>key issues in AI governance from India\u2019s perspective &amp; makes recommendations across\u00a0 <strong>six\u00a0 pillars are:<\/strong><\/p>\n<ol>\n<li><strong> Infrastructure:<\/strong> Enable innovation and adoption of Al by expanding access to foundational resources such as data and compute, attract investments, and leverage the power of digital public infrastructure for scale, impact and, inclusion.<\/li>\n<li><strong> Capacity Building:<\/strong> Initiate education, skilling, and training programs to empower people, build trust, and increase awareness about the risks and opportunities of Al.<\/li>\n<li><strong> Policy &amp; Regulation:<\/strong> Adopt balanced, agile, and flexible frameworks that support innovation and mitigate the risks of Al.
