{"id":35119,"date":"2018-10-31T15:18:36","date_gmt":"2018-10-31T09:48:36","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=35119"},"modified":"2018-10-31T15:18:36","modified_gmt":"2018-10-31T09:48:36","slug":"provide-relief-in-cases-of-unnatural-jail-death-sc-tells-centre-states","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/provide-relief-in-cases-of-unnatural-jail-death-sc-tells-centre-states\/","title":{"rendered":"Provide relief in cases of unnatural jail death, SC tells Centre, States:\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/news\/national\/provide-relief-in-cases-of-unnatural-jail-death-sc-tells-centre-states\/article19693815.ece\"><span style=\"font-weight: 400;\">Provide relief in cases of unnatural jail death, SC tells Centre, States<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p><b>Context<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court directed the Chief Justices of all High Courts to <\/span><i><span style=\"font-weight: 400;\">suo motu<\/span><\/i><span style=\"font-weight: 400;\"> register petitions to identify the kin of prisoners who died unnatural deaths from 2012 and order the States to award them compensation.<\/span><\/li>\n<\/ul>\n<p><b>What has the Bench observed?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is important for the Centre and State governments to realize that persons who suffer an unnatural death in a prison are also victims, sometimes of a crime and sometimes of negligence and apathy or both.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">There is no reason at all to exclude their kin from receiving compensation only because the victim is a criminal, the Bench observed.<\/span><\/li>\n<\/ul>\n<p><b>What were the considerations earlier for compensation?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Typically, the National and States Human Rights Commissions decide and award compensations in cases of custodial torture, deaths, etc.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">However, compliance by State governments is low as these commissions do not exercise any power of contempt.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The States rather go for a long-drawn appeal in the high courts and later on in the Supreme Court, if necessary.<\/span><\/li>\n<\/ul>\n<p><b>Why is this judgement significant?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">This judgment is significant as the high court will now directly award compensation and ensure compliance by the States.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court referred to its judgment as a voice of the victims and an end to the silence of the dead.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Human rights in a welfare state is not dependent on the status of the person, whether he is a criminal or a victim.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The payment from the year 2012 was chosen because National Crimes Records Bureau has records of unnatural deaths from that year.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The judgment came on a letter addressed to the apex court in 2013 by its former Chief Justice R.C.
