Scope:<\/strong>\n<ol style=\"list-style-type: lower-alpha;\">\n<li><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\"><span class=\"citation-24\">Section 2(o) &#8211; Unlawful Activity:<\/span><\/b><span class=\"citation-24\"> Defines it as any action (spoken, written, or physical) that supports the <\/span><b data-path-to-node=\"5,0,0\" data-index-in-node=\"108\"><span class=\"citation-24\">secession<\/span><\/b><span class=\"citation-24\"> of a part of India, questions its <\/span><b data-path-to-node=\"5,0,0\" data-index-in-node=\"152\"><span class=\"citation-24\">sovereignty<\/span><\/b><span class=\"citation-24 citation-end-24\">, or causes &#8220;disaffection&#8221; against India.<\/span><\/li>\n<li><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Section 15 &#8211; Terrorist Act:<\/b><span class=\"citation-23 citation-end-23\"> Defines terrorism broadly to include acts intended to threaten the unity, integrity, security, or sovereignty of India, or to strike terror in the people using explosives, firearms, or other lethal substances.<\/span><\/li>\n<li><b data-path-to-node=\"5,2,0\" data-index-in-node=\"0\">Section 1(4) &#8211; Extra-territorial Jurisdiction:<\/b> The Act applies to Indian and foreign nationals even if the crime is committed <b data-path-to-node=\"5,2,0\" data-index-in-node=\"126\">outside India.<\/b><\/li>\n<\/ol>\n<\/li>\n<li><strong>Investigation &amp; Procedure:<\/strong> The UAPA modifies standard criminal procedures (found in the CrPC\/BNSS) to give more time to investigating agencies:\n<ol style=\"list-style-type: lower-alpha;\">\n<li><b data-path-to-node=\"8,0,0\" data-index-in-node=\"0\">Section 43D(2) &#8211; Extended Detention:<\/b> Under regular law, a charge sheet must be filed within 60 or 90 days. <span class=\"citation-22\">Under UAPA, this can be extended to <\/span><b data-path-to-node=\"8,0,0\" data-index-in-node=\"143\"><span class=\"citation-22\">180 days<\/span><\/b><span class=\"citation-22 citation-end-22\">, meaning a suspect can remain in jail for six months without being formally charged.<\/span><\/li>\n<li><b data-path-to-node=\"8,1,0\" data-index-in-node=\"0\"><span class=\"citation-21 citation-end-21\">Section 43D(5) &#8211; The &#8220;Bail Bar&#8221;:<\/span><\/b> This is the most controversial provision. <span class=\"citation-20\">It states that a court <\/span><b data-path-to-node=\"8,1,0\" data-index-in-node=\"98\"><span class=\"citation-20\">cannot grant bail<\/span><\/b><span class=\"citation-20\"> if, after reading the police report, it finds &#8220;reasonable grounds&#8221; to believe the accusation is <\/span><i data-path-to-node=\"8,1,0\" data-index-in-node=\"212\"><span class=\"citation-20\">prima facie<\/span><\/i><span class=\"citation-20 citation-end-20\"> (at first sight) true.<\/span> In practice, this makes bail the exception and jail the rule.<\/li>\n<li><b data-path-to-node=\"8,2,0\" data-index-in-node=\"0\"><span class=\"citation-19 citation-end-19\">Section 25 &#8211; Seizure of Property:<\/span><\/b><span class=\"citation-18 citation-end-18\"> Allows investigating officers to seize property they believe represents &#8220;proceeds of terrorism,&#8221; subject to approval from senior police or the DG of the NIA.<\/span><\/li>\n<\/ol>\n<\/li>\n<li><strong>2019 Amendments (Power to Designate):\u00a0<\/strong><span class=\"citation-15\">Prior to 2019, the government could only ban <\/span><b data-path-to-node=\"13\" data-index-in-node=\"45\"><span class=\"citation-15\">organizations<\/span><\/b><span class=\"citation-15 citation-end-15\">.<\/span> The amendment introduced a major shift:\n<ol style=\"list-style-type: lower-alpha;\">\n<li><b data-path-to-node=\"14,0,0\" data-index-in-node=\"0\"><span class=\"citation-14\">Section 35 &amp; by adding their name to the Fourth Schedule.<\/span><\/li>\n<li><b data-path-to-node=\"14,1,0\" data-index-in-node=\"0\"><span class=\"citation-13\">Section 43:<\/span><\/b><span class=\"citation-13\"> Empowers officers of the rank of <\/span><b data-path-to-node=\"14,1,0\" data-index-in-node=\"45\"><span class=\"citation-13\">Inspector<\/span><\/b><span class=\"citation-13 citation-end-13\"> and above in the National Investigation Agency (NIA) to investigate cases (previously restricted to ACP\/DSP rank).<\/span><\/li>\n<\/ol>\n<\/li>\n<li><strong>Punishment &amp; Penalties:<\/strong>\u00a0Terrorist acts resulting in death are punishable with death or life imprisonment and fine, while other terrorist acts generally carry a minimum of five years\u2019 imprisonment extendable to life, plus fine.<\/li>\n<\/ol>\n<h2><span style=\"text-decoration: underline;\"><strong><a id=\"h2\"><\/a>What is the need\/significance of the UAPA?<\/strong><\/span><\/h2>\n<ol>\n<li><b class=\"\" data-path-to-node=\"5,0,0\" data-index-in-node=\"0\">Preventing Secession:<\/b><span class=\"\"> The UAPA was originally enacted in 1967 (following the 16th Constitutional Amendment) specifically to address <b class=\"\" data-path-to-node=\"4\" data-index-in-node=\"110\">secessionist movements. <\/b>It gives the state powers to deal with groups or individuals who question India&#8217;s territorial integrity or demand secession (e.<\/span><span class=\"\">g.<\/span><span class=\"\">\u00a0insurgencies in the North-East or the Khalistan movement).<\/span><\/li>\n<li><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Countering &#8220;Unlawful&#8221; Activities:<\/b> Unlike the regular penal code, which focuses on crimes already committed, UAPA targets the <i data-path-to-node=\"5,1,0\" data-index-in-node=\"125\">ideological and organizational<\/i> roots of activities that threaten the nation&#8217;s existence.<\/li>\n<li><b data-path-to-node=\"8,0,0\" data-index-in-node=\"0\">Defining Modern Terror:<\/b><span class=\"citation-57\"> It provides a comprehensive definition of a &#8220;terrorist act&#8221; that includes not just physical violence, but also acts that threaten <\/span><b data-path-to-node=\"8,0,0\" data-index-in-node=\"154\"><span class=\"citation-57\">economic security<\/span><\/b><span class=\"citation-57\"> (like high-quality counterfeit currency) and <\/span><b data-path-to-node=\"8,0,0\" data-index-in-node=\"217\"><span class=\"citation-57\">cybersecurity.<\/span><\/b><\/li>\n<li><b data-path-to-node=\"8,1,0\" data-index-in-node=\"0\"><span class=\"citation-56\">Uprooting Networks:<\/span><\/b><span class=\"citation-56 citation-end-56\"> It allows the government to ban entire organizations (First Schedule) and, since 2019, designate individuals as terrorists.<\/span> This is crucial for stopping &#8220;lone wolf&#8221; attacks and dismantling the leadership of terror modules.<\/li>\n<li><b data-path-to-node=\"11,0,0\" data-index-in-node=\"0\"><span class=\"citation-54\">FATF Compliance:<\/span><\/b><span class=\"citation-54\"> Amendments in 2013 and 2019 were specifically aimed at bringing Indian law in line with the <\/span><b data-path-to-node=\"11,0,0\" data-index-in-node=\"109\"><span class=\"citation-54\">Financial Action Task Force (FATF)<\/span><\/b><span class=\"citation-54 citation-end-54\"> standards to combat money laundering and terror financing.<\/span><\/li>\n<li><b data-path-to-node=\"11,1,0\" data-index-in-node=\"0\">UN Resolutions:<\/b> The Act helps India implement United Nations Security Council (UNSC) resolutions (like Resolution 1373) which require member states to freeze the assets of designated terrorists and prevent their travel.<\/li>\n<li><b data-path-to-node=\"14,1,0\" data-index-in-node=\"0\">Extended Timelines:<\/b> Terrorism cases involve complex international links. The provision allowing <b data-path-to-node=\"14,1,0\" data-index-in-node=\"96\">180 days<\/b> for a charge sheet (instead of 60\/90) gives agencies the necessary time to track foreign funding and digital footprints.<\/li>\n<\/ol>\n<h2><span style=\"text-decoration: underline;\"><strong><a id=\"h3\"><\/a>What are some of the criticisms of the UAPA?<\/strong><\/span><\/h2>\n<ol>\n<li><b data-path-to-node=\"4,0,0\" data-index-in-node=\"0\"><span class=\"citation-123\">Low Conviction Rates:<\/span><\/b><span class=\"citation-123\"> According to government data shared in Parliament (2025), the conviction rate under UAPA remains very low, often cited around <\/span><b data-path-to-node=\"4,0,0\" data-index-in-node=\"148\"><span class=\"citation-123\">3%<\/span><\/b><span class=\"citation-123 citation-end-123\">.<\/span> <span class=\"citation-122 citation-end-122\">Between 2019 and 2023, of over 10,000 arrests, only 335 resulted in convictions.<\/span><\/li>\n<li><b data-path-to-node=\"4,1,0\" data-index-in-node=\"0\"><span class=\"citation-121\">Prolonged Incarceration:<\/span><\/b><span class=\"citation-121\"> High-profile cases, like the <\/span><b data-path-to-node=\"4,1,0\" data-index-in-node=\"54\"><span class=\"citation-121\">Bhima Koregaon<\/span><\/b><span class=\"citation-121\"> case or the <\/span><b data-path-to-node=\"4,1,0\" data-index-in-node=\"81\"><span class=\"citation-121\">Delhi Riots conspiracy<\/span><\/b><span class=\"citation-121 citation-end-121\"> case, have seen activists and students jailed for over 4-5 years without a trial commencing.<\/span><\/li>\n<li><b data-path-to-node=\"7,0,0\" data-index-in-node=\"0\">Prima Facie Standard:<\/b><span class=\"citation-117\"> A judge must deny bail if the police&#8217;s accusations seem &#8220;prima facie true&#8221; and &#8220;Public Order&#8221; are technically <\/span><b data-path-to-node=\"18\" data-index-in-node=\"42\"><span class=\"citation-103\">State subjects<\/span><\/b><span class=\"citation-103 citation-end-103\"> under the Constitution.<\/span> <span class=\"citation-102\">However, UAPA gives the <\/span><b data-path-to-node=\"18\" data-index-in-node=\"112\"><span class=\"citation-102\">National Investigation Agency (NIA)<\/span><\/b><span class=\"citation-102 citation-end-102\">, a central body, the power to take over cases from state police without their consent, which critics see as an erosion of state autonomy.<\/span><\/li>\n<li><strong>2019 Amendment:<\/strong>\u00a0The 2019 amendment enabling the executive to designate individuals (not just organisations) as \u201cterrorists\u201d is criticized for lacking prior judicial determination and adequate hearing safeguards.<\/li>\n<\/ol>\n<h2><span style=\"text-decoration: underline;\"><strong><a id=\"h4\"><\/a>What should be the way forward?<\/strong><\/span><\/h2>\n<ol>\n<li><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\"><span class=\"citation-162\">&#8220;Speedy Trial&#8221; as a Right to Bail:<\/span><\/b><span class=\"citation-162\"> The Supreme Court (in cases like <\/span><i data-path-to-node=\"5,0,0\" data-index-in-node=\"68\"><span class=\"citation-162\">KA Najeeb<\/span><\/i><span class=\"citation-162 citation-end-162\">) has established that if a trial is unlikely to conclude soon and the accused has already spent years in jail, the constitutional right to liberty (Article 21) can override the strict bail bar.<\/span><\/li>\n<li><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Surface Scrutiny of Evidence:<\/b><span class=\"citation-161 citation-end-161\"> Courts are now being urged not to blindly accept the prosecution&#8217;s &#8220;prima facie&#8221; narrative.<\/span> <span class=\"citation-160 citation-end-160\">Judges are encouraged to perform a &#8220;surface analysis&#8221; to see if the evidence actually supports a terror charge or just a minor offense.<\/span><\/li>\n<li><b data-path-to-node=\"5,2,0\" data-index-in-node=\"0\"><span class=\"citation-159\">Specialized Courts:<\/span><\/b><span class=\"citation-159\"> A major recommendation is the creation of dedicated, well-funded <\/span><b data-path-to-node=\"5,2,0\" data-index-in-node=\"85\"><span class=\"citation-159\">Special NIA Courts<\/span><\/b><span class=\"citation-159 citation-end-159\"> to ensure that UAPA trials are conducted on a day-to-day basis, preventing decade-long incarcerations without a verdict.<\/span><\/li>\n<li><b data-path-to-node=\"8,1,0\" data-index-in-node=\"0\">Sunset Clauses or Periodic Review:<\/b> Incorporating a mandatory review by Parliament every few years (similar to the old TADA or POTA) would ensure the law is still necessary and hasn&#8217;t become a tool for political overreach.<\/li>\n<li><b data-path-to-node=\"8,2,0\" data-index-in-node=\"0\">Institutional Accountability:<\/b><span class=\"citation-158 citation-end-158\"> Introducing penalties for officials who willfully file false cases under UAPA would act as a deterrent against &#8220;malicious prosecution.&#8221;<\/span><\/li>\n<li><b data-path-to-node=\"10,0,0\" data-index-in-node=\"0\">Grounds for Designation:<\/b> When an individual is designated as a &#8220;terrorist&#8221;
