{"id":35368,"date":"2018-10-31T17:04:12","date_gmt":"2018-10-31T11:34:12","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=35368"},"modified":"2018-10-31T17:04:12","modified_gmt":"2018-10-31T11:34:12","slug":"rainbow-of-possibilities","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/rainbow-of-possibilities\/","title":{"rendered":"Rainbow of possibilities:\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-opinion\/rainbow-of-possibilities\/article19590669.ece\"><span style=\"font-weight: 400;\">Rainbow of possibilities<\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<p><b>Context<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Right to Privacy (RTP) judgment is a victory for queer persons as it opens out the realm of<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">possibilities for queer rights under the law.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Rulings like RTP <\/span><span style=\"font-weight: 400;\">certainly will strengthen the case for the Constitution Benchthat is scheduled to sit and decide on the Koushal case.<\/span><\/li>\n<\/ul>\n<p><b>Section 377<\/b><b> and its issue<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Same-sex intimacy is understood \u201ccarnal intercourse against the order of nature\u201d in the society.<\/span><\/li>\n<\/ul>\n<p><b>The Koushal case<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The decision on the Koushal case was a lot less vague in its contempt for members of the LGBT community.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The rights of LGBT persons are not given real constitutional rights.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Supreme Court, the highest constitutional court of the country, clearly rejected the right of equal citizenship that the queer community demanded.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Koushal was indeed met with overwhelming critique, from civil society as well as from representatives of a range of political parties.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The National Legal Services Authority v. Union of India judgment, while articulating a charter of rights for transgender individuals, also noted that Section 377, though associated with certain sexual acts, effectively targeted specific identities: a finding the Koushal court refused to make. This implicit critique was a gentle reprimand at best.<\/span><\/li>\n<\/ul>\n<p><b>Righting a wrong<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">With the Right to Privacy judgment, the court\u2019s response to Koushal is anything but gentle.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Justice G.S. Singhvi emphatically noted LGBT Rights cannot be construed as \u201cso-called rights\u201d as the real rights always originate on sound constitutional doctrine.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The Koushal judgment is also called out for referring its constitutional responsibility with the claim that LGBT persons constitute a tiny fraction of the population.<\/span><\/li>\n<\/ul>\n<p><b>Beyond decriminalization<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The judges are allowing to imagine possibilities for queer justice beyond the limiting frame of Section 377.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Even though the court does not make a holding on the constitutional validity of the section, it does find that sexual orientation as an essential attribute of privacy.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The conclusion of Justice Chandrachud\u2019s opinion goes on to hold that privacy includes at its core the preservation of personal intimacies and sexual orientation.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Rainbow of possibilities:\u00a0 Context The Right to Privacy (RTP) judgment is a victory for queer persons as it opens out the realm of possibilities for queer rights under the law.
