TH<\/figcaption><\/figure>\n<ul>\n<li>The Arbitration Council of India (ACI) is a <strong>statutory body<\/strong> established <strong>to promote and regulate arbitration mechanisms<\/strong> in the country.<\/li>\n<li>It is governed by <strong>Part IA (Sections 43A to 43M)<\/strong> of the <strong>Arbitration and Conciliation Act, 1996<\/strong>, as amended in <strong>2019<\/strong>.<\/li>\n<li>It reflects <strong>India\u2019s aim to become a global arbitration hub<\/strong>, especially for commercial disputes.<\/li>\n<li><strong>Headquarter:<\/strong> Its head office shall be in <strong>Delhi<\/strong>.<\/li>\n<li><strong>Composition of ACI<\/strong>\n<ul>\n<li><strong>Chairman:<\/strong> ACI will be <strong>chaired by a former Supreme Court or High Court judge<\/strong> or an <strong>eminent arbitration expert<\/strong>, appointed by the <strong>Central Government<\/strong> in <strong>consultation<\/strong> with the <strong>Chief Justice of India. <\/strong><\/li>\n<li><strong>Full-time Members<\/strong>: It will also have <strong>two Full-time Members<\/strong> from amongst <strong>eminent arbitration practitioners and academicians. <\/strong><\/li>\n<li><strong>Part-time Member<\/strong>: In addition, <strong>one representative<\/strong> of a <strong>recognized body of commerce and industry<\/strong> shall be nominated on rotational basis as a <strong>Part-time Member<\/strong>.<\/li>\n<li><strong>Ex-officio Members<\/strong>\n<ul>\n<li>The <strong>Secretary<\/strong>, Department of Legal Affairs, Ministry of Law &amp; Justice<\/li>\n<li><strong>Secretary<\/strong>, Department of Expenditure, Ministry of Finance<\/li>\n<li><strong>Chief Executive Officer<\/strong>, ACI will be <strong>ex-officio Members.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Functions: <\/strong>As per <strong>Section 43D of the Act<\/strong>, the Council would discharge the following <strong>functions<\/strong>:\n<ul>\n<li>Frame policy governing the grading of arbitral institutions.<\/li>\n<li>Recognize professional institutes providing accreditation of arbitrators.<\/li>\n<li>Review of grading of arbitral institutions and arbitrators.<\/li>\n<li>Hold training, workshops and courses on arbitration in collaboration of law firms, universities and arbitral institutes.<\/li>\n<li>Frame, review and update norms to ensure satisfactory level of arbitration and conciliation.<\/li>\n<li>Act as a forum for exchange of views and techniques to make India a robust centre for domestic and international arbitration.<\/li>\n<li>Make recommendations to the Central Government to make provisions for easy resolution of commercial disputes.<\/li>\n<li>Promote institutional arbitration by strengthening arbitral institutions.<\/li>\n<li>Conduct examination and training on various subjects relating to arbitration and conciliation and award certificates.<\/li>\n<li>Establish and maintain depository of arbitral awards.<\/li>\n<li>Make recommendations regarding personnel, training and infrastructure of arbitral institutions.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: As many as six years after the law was amended, the Union Government is yet to constitute the Arbitration Council of India to regulate and promote institutional arbitration in the country.
