Courts differentiate based on the role of the accused, e.g., <strong>principal conspirators vs. subsidiary actors<\/strong>, but public perception often sees this as arbitrariness.<\/li>\n<li><strong>Prosecution\u2019s Role: <\/strong>Many prosecutors adopt a <strong>mechanical and aggressive approach<\/strong>, opposing bail regardless of merit. Political pressures and fear of criticism discourage prosecutors from exercising discretion.<\/li>\n<li><strong>Delay in Disposal of Cases: <\/strong>Under-trial prisoners often remain in jail for <strong>years<\/strong>, violating basic human rights. In the Delhi riots case, some accused were in <strong>jail for five years<\/strong> before bail was considered.<\/li>\n<li><strong>Human Rights Concerns: <\/strong>Routine incarceration of suspects, especially for minor or subsidiary roles, undermines <strong>human rights and presumption of innocence<\/strong>. High numbers of <strong>under-trial prisoners<\/strong> in India\u2019s jails is a shame and strains the criminal justice system.<\/li>\n<\/ol>\n<h2><strong>Way Forward:<\/strong><\/h2>\n<ol>\n<li>Strengthen <strong>lower court capacity<\/strong> to decide bail quickly and reduce unnecessary escalation to higher courts.<\/li>\n<li>Promote <strong>consistent and transparent standards<\/strong> for bail, with guidelines differentiating roles of accused and nature of offenses.<\/li>\n<li>Encourage <strong>prosecutors<\/strong> to adopt a balanced approach considering humanitarian grounds.<\/li>\n<li>Implement <strong>fast-track procedures<\/strong> for under-trials to ensure timely justice.<\/li>\n<li>Educate public and judiciary about <strong>human rights and presumption of innocence<\/strong>, reinforcing that bail is the norm.<\/li>\n<\/ol>\n<p><strong>Conclusion: <\/strong>Bail should remain the <strong>rule, not the exception<\/strong>, balancing crime control with human rights.
