{"id":35430,"date":"2018-10-31T17:22:20","date_gmt":"2018-10-31T11:52:20","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=35430"},"modified":"2018-10-31T17:22:20","modified_gmt":"2018-10-31T11:52:20","slug":"political-freedoms-necessary-sc","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/political-freedoms-necessary-sc\/","title":{"rendered":"Political freedoms necessary: SC:"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-national\/political-freedoms-necessary-rules-sc\/article19563119.ece\"><span style=\"font-weight: 400;\">Political freedoms necessary: SC<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n<p><b> Context:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court in its privacy judgment on Thursday, said that a free environment for exercising political freedoms such as the right to dissent is necessary to end the malaise of corruption and diversion of funds and welfare benefits.<\/span><\/p>\n<p><b>Court&#8217;s judgment:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The court said \u201cGovernment leaders in authoritarian states\u201d who choke citizens\u2019 political freedoms find themselves often ill-prepared to resolve national crises.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The apex court said that lack of free flow of information and criticism has crippled the ability of the leadership to introspect on their actions and self-correct.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Quoting Nobel laureate Amartya Sen, Justice D.Y. Chandrachud said: \u201cMr Amartya Sen\u2019s analysis reveals that the political immunity enjoyed by government leaders in authoritarian states prevents effective measures being taken in critical situations like famine.\u201d<\/span><\/li>\n<\/ul>\n<p><b>Vibrancy of democracy:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">An enabling atmosphere for citizens to dissent and scrutinise government measures add to the vibrancy of democracy.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Transparency in system:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Justice Chandrachud in his ruling said that capture of social welfare benefits can be obviated only when political systems are transparent and when there is a free flow of information.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Justice also said that the conditions necessary for realising or fulfilling socio-economic rights do not postulate the subversion of political freedom.<\/span><\/li>\n<\/ul>\n<p><b>Vibrant assertion of rights:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Conditions of freedom and a vibrant assertion of civil and political rights promote a constant review of the justness of socio-economic programmes and of their effectiveness in addressing deprivation.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Scrutiny of public affairs is founded upon the existence of freedom.
