Privileges Committee regarding alleged derogatory remarks.<\/span><\/p>\n<h2>About Privileges Committee<\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">The Privileges Committee examines cases of breach of privilege of the House, its members, or its committees and makes recommendations.<\/span><\/li>\n<li><b>Origin: <\/b><span style=\"font-weight: 400;\">Parliamentary privileges in India originated from the Charter Act, 1833 and later developed through the Government of India Act, 1935.<\/span><\/li>\n<\/ul>\n<p><b>Sources of Parliamentary Privileges- <\/b>Privileges of Parliament and State Legislatures are derived from several sources:<\/p>\n<ul>\n<li><b>Constitution of India<\/b><span style=\"font-weight: 400;\">: Articles 105 and 194 grant privileges to Parliament and State Legislatures.<\/span><\/li>\n<li><b>Article 122 and Article 212<\/b><span style=\"font-weight: 400;\"> bar courts from questioning legislative proceedings on procedural grounds.<\/span><\/li>\n<li><b>Parliamentary conventions<\/b><span style=\"font-weight: 400;\"> based on British parliamentary practices.<\/span><\/li>\n<li><b>Statutory laws<\/b><span style=\"font-weight: 400;\"> enacted by Parliament.<\/span><\/li>\n<li><b>Rules of Procedure and Conduct of Business<\/b><span style=\"font-weight: 400;\"> of both Houses.<\/span><\/li>\n<li><b>Judicial interpretations<\/b><span style=\"font-weight: 400;\"> by constitutional courts.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">State Legislatures also have their own Privileges Committees, functioning under the privileges granted to them under Article 194.<\/span><\/p>\n<p><b>Power and Functions of the Privileges Committee<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It examines every question of breach of privilege referred by the House or the Speaker\/Chairman.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It determines, based on facts, whether a breach of privilege has occurred.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It makes recommendations to the House regarding action to be taken.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It states the procedure for implementing its recommendations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It may conduct preliminary inquiry in defection-related petitions if referred by the Speaker\/Chairman.<\/span><\/li>\n<\/ul>\n<p><b>Composition of the Privileges Committee:\u00a0<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The committee has <\/span><b>15 members in Lok Sabha<\/b><span style=\"font-weight: 400;\"> and <\/span><b>10 members in Rajya Sabha<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Members are <\/span><b>nominated by the Speaker in Lok Sabha<\/b><span style=\"font-weight: 400;\"> and by the <\/span><b>Chairman in Rajya Sabha.\u00a0<\/b><\/li>\n<li><span style=\"font-weight: 400;\">In Rajya Sabha, the <\/span><b>Deputy Chairman heads the committee.<\/b><\/li>\n<\/ul>\n<p><b>Procedure<\/b><\/p>\n<ul>\n<li><b>Initiation Stage: <\/b><span style=\"font-weight: 400;\">A question of privilege is raised only with the consent of the Speaker or the Chairman, who decides whether the matter should proceed further.<\/span><\/li>\n<li><b>Reference Decision: <\/b><span style=\"font-weight: 400;\">After consent, the House may choose to consider the matter directly or refer it to the Committee of Privileges for detailed examination.<\/span><\/li>\n<li><b>Committee Inquiry: <\/b><span style=\"font-weight: 400;\">The Committee studies the issue carefully, examines the facts of the case, and prepares a report along with its recommendations.<\/span><\/li>\n<li><b>Final Decision: <\/b><span style=\"font-weight: 400;\">The House considers the committee\u2019s report and takes the final action in accordance with its decision.<\/span><\/li>\n<\/ul>\n<p><b>Punishment<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">If a breach of privilege or contempt of the House is established, punishment may include warning, reprimand, imprisonment, or enforcement of attendance.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">For members, penalties may include suspension or expulsion.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Custody or punishment may be limited to the duration of the House
