{"id":35967,"date":"2018-11-01T12:44:20","date_gmt":"2018-11-01T07:14:20","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=35967"},"modified":"2018-11-01T12:44:20","modified_gmt":"2018-11-01T07:14:20","slug":"whats-at-stake-in-hyderabad","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/whats-at-stake-in-hyderabad\/","title":{"rendered":"What\u2019s at stake in Hyderabad\u00a0:"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/opinion\/op-ed\/whats-at-stake-in-hyderabad\/article19372743.ece\"><span style=\"font-weight: 400;\">What\u2019s at stake in Hyderabad\u00a0<\/span><\/a><span style=\"font-weight: 400;\">: <\/span><\/p>\n<p><b>Context :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">India must counter Japan\u2019s U.S.-style pressure at the RCEP talks and ensure affordable generic medicines.<\/span><\/li>\n<\/ul>\n<p><b>Discussion about leaked documents :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">All public discussions on the <\/span><b>Regional Comprehensive Economic Partnership<\/b><span style=\"font-weight: 400;\"> (RCEP) are centering around leaked documents.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The RCEP will open two of the world\u2019s fastest-growing economies to new standards of Intellectual Property (IP) protection with some unforeseen consequences.<\/span><\/li>\n<\/ul>\n<p><b>Intellectual Property (IP), investment and RCEP :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Formation of Investor State Dispute Settlement mechanism and to include IP as an investment is major conditions that have been put forth both in the TPP as well as the RCEP.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">IP as an investment will lead to private companies raising investment disputes against the host country in case when legal regime doesn\u2019t favour them.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">These disputes mostly get initiated by MNCs and especially the pharmaceutical industries.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Japan\u2019s insistence on the inclusion of this clause comes as no surprise as it is the third-largest RCEP investor country.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Countries like India and China, which will be the destinations for the investments, should include safeguards against these measures.<\/span><\/li>\n<\/ul>\n<p><b>The new reforms :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The leaked IP chapter shows that both Japan and South Korea are mounting pressure to implement a TRIPS-plus regime in IP.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Such pressure is damaging to developing countries that have benefited from generic competition.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The few IP reforms discussed in the RCEP include data exclusivity, patent term extension, and much more lenient criteria for patentability.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Following those would mean delay in the entry of generic versions of medicines, extension of patent monopoly for a longer time.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The strong MNC lobby growing in Japan, especially on the pharmaceutical side, is a reason for its insistence on stricter IP rules. by Otsuka for the treatment of extensively drug-resistant tuberculosis (TB).<\/span><\/li>\n<\/ul>\n<p><b>MFN Clause: what it means to India? :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The WTO has a most-favoured-nation (MFN) clause that obliges the concessions offered to the MFN to be offered to others.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">If India has an agreement with Japan (through the RCEP), India will be obliged to offer the same concessions to the U.S. as well as the other members of the WTO.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The negotiating pattern reflects the reality of international law making.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It is evident that developed countries are using FTAs to expand the existing standards of IP.<\/span><\/li>\n<\/ul>\n<p><b>What should India do? :<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">At the 19th round of the RCEP negotiations currently on in Hyderabad, India must resist Japan\u2019s U.S.-style pressure in this regard.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">India should not only proudly protect their laws in the RCEP negotiations, they should also encourage other countries to adopt and use similar measures that ensure generic competition.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>What\u2019s at stake in Hyderabad\u00a0: Context : India must counter Japan\u2019s U.S.-style pressure at the RCEP talks and ensure affordable generic medicines.
