{"id":36032,"date":"2018-11-01T13:13:23","date_gmt":"2018-11-01T07:43:23","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=36032"},"modified":"2018-11-01T13:13:23","modified_gmt":"2018-11-01T07:43:23","slug":"speaking-for-the-voiceless","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/speaking-for-the-voiceless\/","title":{"rendered":"Speaking for the voiceless:"},"content":{"rendered":"<p><a href=\"http:\/\/indianexpress.com\/article\/opinion\/columns\/speaking-for-the-voiceless-posco-act-rapes-of-minors-4761644\/\"><span style=\"font-weight: 400;\">Speaking for the voiceless<\/span><\/a><span style=\"font-weight: 400;\">: (Indian Express, Editorial)<\/span> <b>A need to redefine the process of criminal justice<\/b><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">An analysis of rape cases of minors reveals that nothing has changed even after the enactment of the Protection Of Children from Sexual Offences (POSCO) Act in 2012. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Criminal justice process would benefit from more elements of inquisitorial system.<\/span><\/li>\n<\/ul>\n<p><b>The drawback:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">In most cases when the medical examination of minor victims is not granted by their guardians then more emphasis needs to be laid on oral evidence.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">But it has been found that comparatively less importance is given to the uncorroborated oral evidence in cases where the consent for medical examination is withheld.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The adversarial system of dispensing justice had not worked satisfactorily in India and some beneficial features of the inquisitorial system should be incorporated.<\/span><\/li>\n<li><\/li>\n<li>As for example:<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">o<\/span> <span style=\"font-weight: 400;\">In an inquisitorial system, as applicable in China, Russia, Japan, Scotland, etc judicial magistrates investigate criminal offences and search for the truth.<\/span> <span style=\"font-weight: 400;\">o<\/span> <span style=\"font-weight: 400;\"> In Germany, a breach of the judges\u2019 duty to actively discover truth would amount to a procedural error which may provide grounds for an appeal.<\/span> <span style=\"font-weight: 400;\">o<\/span> <span style=\"font-weight: 400;\"> Italy uses a blend of two systems.<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Having a separate law like the POCSO Act does not seem to be sufficient to dispense justice to a spectrum of victims who are not even capable of comprehending the trauma of sexual violence.<\/span><\/li>\n<\/ul>\n<p><b>Suggestion:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Investigative powers can be given to the judicial magistrates in cases of rape of children under 12 years of age.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The investigative judicial (woman) magistrate could be assisted by a female medical doctor and an expert in child psychology.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The report of such magistrate could be treated as a final piece of evidence and the accused may be given an opportunity to state and defend his version.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Speaking for the voiceless: (Indian Express, Editorial) A need to redefine the process of criminal justice Context: An analysis of rape cases of minors reveals that nothing has changed even after the enactment of the Protection Of Children from Sexual Offences (POSCO) Act in 2012.
