{"id":36256,"date":"2018-11-02T11:32:50","date_gmt":"2018-11-02T06:02:50","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=36256"},"modified":"2018-11-02T11:32:50","modified_gmt":"2018-11-02T06:02:50","slug":"law-morality-triple-talaq","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/law-morality-triple-talaq\/","title":{"rendered":"Law, morality, triple talaq:\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/indianexpress.com\/article\/opinion\/columns\/law-morality-triple-talaq-muslim-islam-4743272\/\"><span style=\"font-weight: 400;\"><strong>Law, morality, triple talaq<\/strong><\/span><\/a><span style=\"font-weight: 400;\">:\u00a0<\/span><\/p>\n<hr \/>\n<p><strong>(Triple Talaq-a conflict between law and morality)<\/strong> <strong>Context:<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The issue is not whether triple talaq is an essential practice of Islam, but whether it is an essential practice of the Hanafi school.<\/span><\/li>\n<\/ul>\n<p><strong>The difference:<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">The concept of \u201csin\u201d draws on blind beliefs based on morality and no court can make something pious if a religious sect considers it sinful. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Thus, if a person makes a gift of his entire property in favor of one of his children to the exclusion of others, such a gift is sinful but valid. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">Even the Prophet\u2019s strong disapproval cannot make an action illegal under the Hanafi school.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Though the Prophet has expressed his displeasure on bequeathing property to one child while excluding others as well as on instant triple talaq, both practices remain valid under the Hanafi School.<\/span><\/li>\n<\/ul>\n<p><strong>Problems: <\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Once there is triple divorce, the Hanafi School regards resumption of the matrimonial relationship between the divorced couple as both sinful and illegal.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">If illiterate masses, neighborhood and relatives continue to regard such a reunion as sinful and illegitimate, This will indirectly be creating more problems for the couple and their children. <\/span><\/li>\n<li><span style=\"font-weight: 400;\">There is a divergence of opinion amongst Islamic jurists which means that there are several schools of Islamic law.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> In India, most Muslims follow the Hanafi school. The controversy over instant triple talaq stems from the fact that this school deems this practice as valid.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">And moreover, Article 26 of the Constitution guarantees freedom \u201cin matters of religion\u201d to not only \u201cevery religious denomination\u201d but also to \u201cto any sect thereof\u201d.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Thus, the Hanafi school enjoys constitutional protection.<\/span><\/li>\n<\/ul>\n<p><strong>Suggestions:<\/strong><\/p>\n<ul>\n<li>We must educate people and the Board must ensure that all divorces henceforth happen as per the Quranic procedure.<\/li>\n<li>The best solution to remove the menace of triple divorce under the Hanafi School is to order the incorporation of an explicit condition in the nikahnama that there shall be no instant triple divorce and the wife too will have a right to divorce.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Law, morality, triple talaq:\u00a0 (Triple Talaq-a conflict between law and morality) Context: The issue is not whether triple talaq is an essential practice of Islam, but whether it is an essential practice of the Hanafi school.
