{"id":36274,"date":"2018-11-02T11:42:30","date_gmt":"2018-11-02T06:12:30","guid":{"rendered":"https:\/\/blog.forumias.com\/?p=36274"},"modified":"2018-11-02T11:42:30","modified_gmt":"2018-11-02T06:12:30","slug":"centre-eases-pre-merger-filing-norms","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/centre-eases-pre-merger-filing-norms\/","title":{"rendered":"Centre eases pre-merger filing norms:"},"content":{"rendered":"<p><a href=\"http:\/\/www.thehindu.com\/todays-paper\/tp-business\/centre-eases-pre-merger-filing-norms\/article19237091.ece\"><span style=\"font-weight: 400;\">Centre eases pre-merger filing norms<\/span><\/a><span style=\"font-weight: 400;\">: (The Hindu)<\/span><\/p>\n<p><b>Context:<\/b><\/p>\n<ul>\n<li><b><\/b>In order to boost mergers and acquisitions (M&amp;A), the center removes 30-day notice rule.<\/li>\n<\/ul>\n<p><b>Introduction:<\/b><\/p>\n<ul>\n<li><b><\/b><b> <\/b>According to a notification on June 29 by the Ministry of Corporate Affairs, the government, in public interest has done away with the thirty-day time period to submit an application for pre-merger clearance before the <strong>Competition Commission of India<\/strong> (CCI).<\/li>\n<li>This new provision (exemption from the 30-day time period) will be valid for five years starting June 29, 2017.<\/li>\n<\/ul>\n<p><b>Merits:<\/b><\/p>\n<ul>\n<li><b><\/b>Now, the parties can make a CCI application at any time in course of an acquisition.<\/li>\n<li>The new notification provides the parties with liberty and flexibility to decide at what stage they want to make the CCI filing, depending on the deal parameters and commercial terms.<\/li>\n<li>This initiative will be beneficiary for multi-jurisdiction transactions where parties may be burdened with regulatory requirements in several jurisdictions and, for which, they need more time to assess the Indian law implications and prepare a comprehensive CCI application.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Centre eases pre-merger filing norms: (The Hindu) Context: In order to boost mergers and acquisitions (M&amp;A), the center removes 30-day notice rule.
