However, it does <strong>not establish nationality.<\/strong><\/li>\n<li><strong>Citizenship proof:<\/strong> It establishes that a person is <strong>legally recognised as an Indian citizen under the Citizenship Act, 1955.<\/strong> When <strong>citizenship is questioned, courts examine how citizenship was acquired and assess<\/strong> the relevant documentary evidence.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Legal Backup:<\/strong>\n<ul>\n<li><strong>Citizenship Act, 1955:<\/strong> It lays down the <strong>legal framework for acquiring Indian citizenship by birth, descent, registration and naturalisation<\/strong>.<\/li>\n<li><strong>Foreigners Act, 1946:<\/strong> Under Section 9, when credible doubts are raised about a person\u2019s nationality, the <strong>burden shifts to that person to establish Indian citizenship.<\/strong><\/li>\n<li><strong>Passports Act, 1967:<\/strong> It governs the <strong>issue, refusal, cancellation and revocation of passports<\/strong>.\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>It also provides that a passport is issued only after necessary inquiry, but <strong>it is not treated as conclusive proof of citizenship.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Proofs of Indian Citizenship:<\/strong>\u00a0The <strong>Citizenship Act, 1955 recognises four principal modes<\/strong> of acquiring Indian citizenship:\n<ul>\n<li><strong>By Birth:<\/strong> A <strong>person born in India between 26 January 1950 and 1 July 1987<\/strong> is an Indian <strong>citizen by birth.<\/strong>\n<ul>\n<li>The <strong>conditions differ<\/strong> for those <strong>born after these dates<\/strong>, and <strong>citizenship is established<\/strong> through a <strong>birth certificate<\/strong> and other records showing eligibility under the Act.<\/li>\n<\/ul>\n<\/li>\n<li><strong>By Descent:<\/strong> A <strong>person born outside India to Indian parents<\/strong> can establish <strong>citizenship through the parents&#8217; citizenship documents<\/strong> and <strong>registration of birth at an Indian consulate or embassy<\/strong>, where applicable.<\/li>\n<li><strong>By Registration:<\/strong> Certain categories, including <strong>persons of Indian origin and spouses of Indian citizens<\/strong>, can acquire <strong>citizenship through registration and receive a Certificate of Registration<\/strong> from the Central Government.<\/li>\n<li><strong>By Naturalisation:<\/strong> <strong>Foreign nationals<\/strong> who <strong>fulfil the eligibility conditions under the Citizenship Act, 1955, can acquire Indian citizenship<\/strong> and receive a <strong>Certificate of Naturalisation as official proof.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Judiciary View:<\/strong>\n<ul>\n<li><strong>Supreme Court (SIR Case):<\/strong> The Court held that <strong>Aadhaar is only proof of identity<\/strong> and <strong>not conclusive proof of Indian citizenship<\/strong>.\n<ul>\n<li>It also stated that Aadhaar can be used <strong>only as proof of identity while filing claims and objections.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Bombay High Court (Bail Case of an Alleged Bangladeshi National):<\/strong> The Court ruled that <strong>possession of Aadhaar, PAN card, Voter ID or passport, by itself, does not establish Indian citizenship<\/strong> in a court of law.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Documents that are Not Conclusive Proof of Citizenship:<\/strong>\n<ul>\n<li><strong>Aadhaar Card:<\/strong> It is <strong>proof of identity and not conclusive proof of citizenship.<\/strong><\/li>\n<li><strong>Voter ID:<\/strong> It establishes <strong>identity for voting but does not independently prove citizenship.<\/strong><\/li>\n<li><strong>PAN Card<\/strong>: It is a <strong>financial and tax identity document<\/strong> and does not establish citizenship.<\/li>\n<li><strong>Passport<\/strong>: It is an <strong>official travel document<\/strong> issued to Indian citizens but is not conclusive proof of citizenship in legal disputes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News:\u00a0The Ministry of External Affairs clarified that an Indian passport is a travel document and not conclusive proof of Indian citizenship.
