{"id":369682,"date":"2026-08-17T15:39:46","date_gmt":"2026-08-17T10:09:46","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=369682"},"modified":"2026-08-17T15:39:46","modified_gmt":"2026-08-17T10:09:46","slug":"legislative-privileges","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/legislative-privileges\/","title":{"rendered":"Legislative Privileges"},"content":{"rendered":"<div class=\"content-box-green\">\n<p><strong>News<\/strong>: The Supreme Court\u2019s seven-judge Constitution Bench will hear and clarify whether legislative privileges can override citizens\u2019 right to free speech.<\/p>\n<\/div>\n<h2 class=\"red-h2-box\">About Legislative Privileges<\/h2>\n<figure style=\"width: 414px\" class=\"wp-caption aligncenter\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"\" src=\"https:\/\/i0.wp.com\/assets.thehansindia.com\/h-upload\/2026\/08\/13\/1689295-sc.webp?resize=414%2C249&#038;ssl=1\" alt=\"legislative privileges \" width=\"414\" height=\"249\" \/><figcaption class=\"wp-caption-text\">Source: Hans India<\/figcaption><\/figure>\n<ul>\n<li>Parliamentary privilege refers to <strong>rights and immunities enjoyed by Parliament<\/strong> as an institution and MPs in their individual capacity, without which they cannot discharge their functions as entrusted to them by the Constitution.<\/li>\n<li>According to the Constitution, the <strong>powers, privileges, and immunities of Parliament and MP\u2019s<\/strong> are <strong>to be defined by Parliament<\/strong>.<\/li>\n<li>According to the Constitution of India, <strong>Articles 105 and 122 outline the privileges of Parliament.<\/strong><\/li>\n<li><strong>Articles 194 and 212<\/strong> pertain to the privileges of state governments.\n<ul>\n<li><strong>Article 105:<\/strong> There shall be freedom of speech in Parliament.<\/li>\n<li><strong>Article 105(2) of the Constitution:<\/strong> No member of Parliament shall be liable to any proceedings in any court in respect of anything said or any vote given by him in Parliament or any committee thereof.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Article 122:<\/strong> The validity of any proceedings in Parliament shall not be called in question in court on the ground of any alleged irregularity of procedure.<\/li>\n<li><strong>Article 194 and Article 212<\/strong> are corresponding articles for the state legislature.\n<ul>\n<li><strong>Article 194 of the Indian Constitution<\/strong> have mention about privileges of the state legislature<\/li>\n<li><strong>Privileges of a state legislature are a sum of special rights, immunities, and exemptions<\/strong> enjoyed by the state legislature and its members.<\/li>\n<li><strong>Privileges are considered necessary<\/strong> to secure the independence and effectiveness of the legislature and the actions of legislative members.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Article 212 of the Indian Constitution<\/strong> stipulates that courts are not allowed to inquire into the proceedings of Parliament and State Legislatures, respectively.\n<ul>\n<li>It guarantees that the<strong> judiciary would not meddle in legislative matters.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>Each<strong> House of Parliament is the guardian of its privileges.<\/strong>\n<ul>\n<li>The Code of Civil Procedure protects MPs from arrest and detention in civil cases during a parliamentary session.<\/li>\n<\/ul>\n<\/li>\n<li>A <a href=\"https:\/\/forumias.com\/blog\/breach-of-privilege-notice\/\"><strong>Breach of Privilege<\/strong><\/a> is the violation of the respective rights and immunities of either House of Parliament and State Legislative Assembly<\/li>\n<li><strong>Note<\/strong>: <strong>Freedom of Speech granted to members of the State legislature is not absolute<\/strong>, as such freedom is subject to restrictions.\n<ul>\n<li>It is <strong>subject to the provisions of the Constitution<\/strong> and to the rules and standing orders regulating the procedure of the state legislature.<\/li>\n<\/ul>\n<\/li>\n<li>In this regard, the Supreme Court has decided that a seven-judge Constitution Bench will hear and clarify whether legislative privilege can be used to restrict freedom of speech and press freedom under Article 19(1)(a).<\/li>\n<\/ul>\n<table style=\"border-collapse: collapse; width: 100%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<h2 class=\"red-h2-box\" style=\"text-align: center;\">About Judicial Stance on this Issue<\/h2>\n<ul>\n<li>In the 1970 ruling in \u2018<strong>Tej Kiran Jain v N Sanjiva Reddy\u2019,<\/strong> the Supreme Court ruled that \u201c<strong>the word \u201canything\u201d in Article 105<\/strong> is of the <strong>widest import<\/strong> and is <strong>equivalent to \u2018everything\u2019.<\/strong><\/li>\n<li>In \u2018<strong>P V Narasimha Rao case (1998)<\/strong>\u2019 a five-judge Bench of the apex court ruled that the <strong>ordinary law would not apply to the acceptance of a bribe<\/strong> by an <strong>MP in case of parliamentary proceedings<\/strong>.\n<ul>\n<li>The court interpreted <strong>Article 105(2)<\/strong> and said that it <strong>protects MPs against proceedings in court related to anything said or a vote given in Parliament.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>The Court said that it will \u201c<strong>enable members to participate fearlessly in Parliamentary debates<\/strong>\u201d and that these members need the <strong>wider protection of immunity against all civil and criminal proceedings<\/strong> that bear a <strong>nexus to their speech or vote.<\/strong><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n","protected":false},"excerpt":{"rendered":"<p>News: The Supreme Court\u2019s seven-judge Constitution Bench will hear and clarify whether legislative privileges can override citizens\u2019 right to free speech.
