{"id":370538,"date":"2026-08-28T11:53:53","date_gmt":"2026-08-28T06:23:53","guid":{"rendered":"https:\/\/forumias.com\/blog\/?p=370538"},"modified":"2026-08-28T11:54:39","modified_gmt":"2026-08-28T06:24:39","slug":"un-committee-on-the-elimination-of-racial-discrimination-uncerd","status":"publish","type":"post","link":"https:\/\/forumias.com\/blog\/un-committee-on-the-elimination-of-racial-discrimination-uncerd\/","title":{"rendered":"UN Committee on the Elimination of Racial Discrimination (UNCERD)"},"content":{"rendered":"<div class=\"content-box-green\">\n<p><strong>News:<\/strong> India rejected what it called \u201cpolitically motivated\u201d and \u201cmalicious\u201d references made by UNCERD after its 11th periodic review in Geneva.<\/p>\n<\/div>\n<h2 class=\"red-h2-box\">About UN Committee on the Elimination of Racial Discrimination (UNCERD)<\/h2>\n<ul>\n<li>UNCERD is a <strong>United Nations treaty body<\/strong> that <strong>monitors the implementation of the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD)<\/strong>.\n<ul>\n<li>It is <strong>not a principal organ of the United Nations<\/strong> or a judicial court.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Establishment:<\/strong> It was established under ICERD, which was adopted in 1965 and entered into force in 1969.<\/li>\n<li><strong>Composition:<\/strong> The <strong>Committee consists of 18 independent experts<\/strong> who serve in their personal capacity and <strong>not as representatives of governments.<\/strong><\/li>\n<li><strong>Aim:<\/strong> It aims to <strong>ensure that States Parties fulfil their obligations<\/strong> to prohibit and eliminate racial discrimination and promote racial harmony and equality before law.<\/li>\n<li><strong>Key Functions:<\/strong>\n<ul>\n<li><strong>Periodic Review:<\/strong> States Parties submit periodic reports, which the Committee examines to monitor the implementation of ICERD.<\/li>\n<li><strong>Concluding Observations:<\/strong> It issues observations and recommendations after examining State reports and interacting with their delegations.<\/li>\n<li><strong>Early Warning and Urgent Action:<\/strong> It monitors developing tensions to prevent them from escalating into racial or ethnic conflict.<\/li>\n<li><strong>Complaint Procedures:<\/strong> It can examine inter-State disputes and individual communications where a State has recognised its competence.<\/li>\n<\/ul>\n<\/li>\n<li><strong>India&#8217;s Status:<\/strong>\n<ul>\n<li><strong>State Party:<\/strong> <strong>India signed ICERD in 1967<\/strong> and <strong>ratified it in 1968.<\/strong>\n<ul>\n<li>It also played a <strong>leading role in negotiating and drafting the Convention.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Recent Review:<\/strong> India <strong>participated in its 11th periodic review in Geneva on August 11 and 12, 2026.<\/strong><\/li>\n<li><strong>Committee\u2019s Concerns:<\/strong> The Committee raised concerns about reported violations against ethnic and ethno-religious groups, Indigenous and Tribal Peoples, Scheduled Tribes, Scheduled Castes, migrants and asylum-seekers<strong>.<\/strong>\n<ul>\n<li>It also highlighted issues related to law enforcement actions, racial profiling, arbitrary detention, deportation, hate speech and hate crimes.<\/li>\n<\/ul>\n<\/li>\n<li><strong>India\u2019s Response:<\/strong> India rejected the Committee\u2019s observations and references, describing them as politically motivated and malicious.\n<ul>\n<li>It stated that the observations contained sweeping generalisations and unsubstantiated allegations and went beyond the mandate of the Convention.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>News: India rejected what it called \u201cpolitically motivated\u201d and \u201cmalicious\u201d references made by UNCERD after its 11th periodic review in Geneva.
