Context: <\/strong>The concept of the OBC creamy layer<\/strong> seeks to exclude socially and economically advanced sections among OBCs from reservation benefits. The Supreme Court\u2019s March 11, 2026 judgment in Union of India vs Rohith Nathan<\/em><\/strong> addressed the manner in which the income\/wealth test should be applied to certain OBC candidates.<\/p>\n

Supreme Court\u2019s ruling:<\/strong><\/h2>\n
    \n
  1. The cases involved OBC candidates whose parents worked in PSUs or the private sector<\/strong>, where equivalence of posts with government services had not been established.<\/li>\n
  2. The Court held that such candidates cannot be treated differently<\/strong> from OBC candidates in other categories for creamy-layer determination.<\/li>\n
  3. The income\/wealth test should operate as a \u201cresidual filter\u201d<\/strong>. The 1993 DoPT Office Memorandum had consciously excluded salary and agricultural income<\/strong> while applying the test.<\/li>\n
  4. The Court found that the subsequent 2004 DoPT letter had resulted in the inclusion of salary income in certain cases, creating \u201chostile discrimination\u201d<\/strong> between children of government employees and those of PSU\/private-sector employees.<\/li>\n
  5. The Court directed the Centre to implement this interpretation within six months and create supernumerary posts<\/strong> for affected OBC candidates according to their CSE ranks.<\/li>\n<\/ol>\n

    Why is the Centre seeking clarification?<\/strong><\/h2>\n

    1. The Centre argues that retrospective implementation<\/strong> would be extremely difficult and could have a cascading effect on settled services from 2012 onwards<\/strong>.<\/li>\n
    2. It apprehends a large number of claims for adjustment and seniority disputes<\/strong> arising from retrospective changes.<\/li>\n
    3. The impact could extend beyond OBC candidates to all categories, including the Unreserved category<\/strong>.<\/li>\n

It has also argued that salary income may sometimes be the \u201csole intelligible differentia\u201d<\/strong> between OBC candidates from similar social backgrounds and raised concerns about cases where parents earning up to \u20b91 crore<\/strong> could potentially be considered non-creamy layer if salary is excluded.<\/li>\n<\/ol>\n

      Way Forward<\/strong><\/h2>\n
        \n
      1. Clear implementation guidelines:<\/strong> The Centre should issue clear, uniform guidelines on the application of the income\/wealth test to avoid arbitrary interpretation by authorities.<\/li>\n
      2. Prospective implementation: <\/strong>To protect settled services and seniority, the Court may consider a clearly defined framework for implementing the judgment prospectively while addressing genuinely affected candidates.<\/li>\n
      3. Equivalence of posts:<\/strong> The government should establish equivalence between PSU\/private-sector posts and government-service posts at the earliest to ensure uniform application of creamy-layer criteria.<\/li>\n
      4. Avoid retrospective disruption:<\/strong> Any corrective exercise should minimise disruption to already settled recruitments, service allocations and seniority, particularly where third-party rights are involved.<\/li>\n
      5. Balanced income criterion:<\/strong> The policy should ensure that exclusion from reservation reflects social and economic advancement, while preventing salary income from becoming an arbitrary basis for treating similarly placed candidates differently.<\/li>\n
      6. Judicial clarification: <\/strong>The Supreme Court should clearly settle the scope, temporal application and procedure for implementing the March 11 judgment so that prolonged litigation and administrative uncertainty are avoided.<\/li>\n<\/ol>\n

        Conclusion: <\/strong>The issue involves balancing substantive equality and non-discrimination with administrative certainty and protection of settled rights. A clear, uniform and carefully phased implementation framework can reconcile both objectives.<\/p>\n
