410px\" \/><\/p>\n<h2 class=\"yellow-h2-box\"><strong>Why Has Ladakh Been Seeking Constitutional Protection?<\/strong><\/h2>\n<ol>\n<li><strong>2019 reorganisation of J&amp;K:<\/strong> In 2019, the erstwhile State of Jammu and Kashmir was reorganised, and <strong>Ladakh became a separate Union Territory without a legislative assembly<\/strong>.<\/li>\n<li><strong>Loss of elected representation:<\/strong> Ladakh had <strong>four MLAs<\/strong> in the erstwhile J&amp;K Assembly, but after becoming a UT without a legislature, its administration became largely bureaucratic.<\/li>\n<li><strong>Change in political expectations:<\/strong> Leh had long demanded UT status because it felt neglected by the erstwhile Jammu and Kashmir government, but the absence of a legislature later created concerns over democratic representation.<\/li>\n<li><strong>Concerns over land and identity:<\/strong> Changes in domicile rules increased concerns about <strong>land, employment, demography and protection of Ladakh<\/strong><strong>\u2019<\/strong><strong>s distinct cultural identity<\/strong>.<\/li>\n<li><strong>Limited Hill Council powers:<\/strong> Ladakh has Hill Councils in <strong>Leh and Kargil<\/strong>, but neither is covered by the Sixth Schedule, leaving their powers limited.<\/li>\n<li><strong>Demand for stronger safeguards:<\/strong> These concerns led to demands for <strong>statehood, tribal status, Sixth Schedule protection and greater local control<\/strong> over administration, land and infrastructure decisions.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>What Has the Centre Proposed Under Article 371(K)?<\/strong><\/h2>\n<ol>\n<li><strong>New constitutional provision:<\/strong> The Centre has proposed <strong>Article 371(K) under Part XXI<\/strong>, which contains temporary, transitional and special provisions for specific regions and states.<\/li>\n<li><strong>Article 371 and its present scope:<\/strong> Article 371 and provisions from <strong>371-A to 371-J<\/strong> provide special arrangements for <strong>12 States<\/strong>, covering different political, cultural, social and economic interests.<\/li>\n<li><strong>Directly elected UT body:<\/strong> The proposed arrangement would create a governing body for Ladakh whose members would be chosen through <strong>direct elections<\/strong>.<\/li>\n<li><strong>Legislative subjects:<\/strong> The body would have legislative powers over <strong>land, culture and language, forests, environment and natural resources<\/strong>.<\/li>\n<li><strong>Article 240 subjects:<\/strong> Its legislative role could also cover other subjects reserved for Ladakh under <strong>Article 240<\/strong>, which allows the President to make laws for specified Union Territories.<\/li>\n<li><strong>A new constitutional model for a UT:<\/strong> Article 371(K) would create a <strong>separate constitutional arrangement for Ladakh<\/strong>, marking a departure because existing special provisions under Article 371 apply to states.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>How Would Article 371(K) Change Ladakh\u2019<\/strong><strong>s Governance?<\/strong><\/h2>\n<ol>\n<li><strong>Greater elected participation:<\/strong> A directly elected UT-level body would give local representatives a formal role has largely been led by bureaucrats since 2019.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>What Is the Difference Between Article 371(K) and the Sixth Schedule?<\/strong><\/h2>\n<ol>\n<li><strong>Sixth Schedule framework:<\/strong> The Sixth Schedule creates <strong>Autonomous District Councils<\/strong> with constitutionally defined legislative, judicial and administrative powers within states.<\/li>\n<li><strong>Subjects under Sixth Schedule:<\/strong> These councils can regulate matters including <strong>land, forests, water, agriculture, village councils, health, inheritance, social customs and mining<\/strong>.<\/li>\n<li><strong>Present geographical scope:<\/strong> The Sixth Schedule applies to tribal areas in <strong>Assam, Meghalaya, Mizoram and Tripura<\/strong>.<\/li>\n<li><strong>Ladakh\u2019<\/strong><strong>s earlier recommendation:<\/strong> The National Commission for Scheduled Tribes recommended Sixth Schedule protection for Ladakh in 2019, citing its <strong>tribal population and distinct cultural heritage<\/strong>.<\/li>\n<li><strong>Tribal protection remains distinct:<\/strong> With <strong>97% of Ladakh<\/strong><strong>\u2019<\/strong><strong>s population being tribal<\/strong>, people have demanded Sixth Schedule protection to give local councils greater autonomy to protect the region\u2019s <strong>environment and culture<\/strong>.<\/li>\n<li><strong>Different institutional model:<\/strong> Article 371(K) proposes a <strong>directly elected UT-level body<\/strong> with specified legislative powers, rather than Sixth Schedule-style autonomous district institutions.<\/li>\n<li><strong>Separate constitutional route:<\/strong> The proposal would create a distinct arrangement for Ladakh, while its exact difference from the Sixth Schedule depends on the final draft.<\/li>\n<\/ol>\n<h2 class=\"yellow-h2-box\"><strong>What Powers and Demands Remain Unresolved?<\/strong><\/h2>\n<ol>\n<li><strong>No detailed draft yet:<\/strong> Ladakh representatives have not received a draft specifying the proposed body\u2019s powers, making the Centre\u2019s while the Centre has only agreed to discuss these demands in October.<\/li>\n<li><strong>Limits on Lieutenant Governor:<\/strong> The <strong>Leh Apex Body (LAB)<\/strong> and <strong>Kargil Democratic Alliance (KDA)<\/strong> want no major decisions on <strong>administration, bureaucracy or land<\/strong> until constitutional safeguards and the elected body are established.<\/li>\n<li><strong>Protection against irreversible changes:<\/strong> They oppose major irreversible restructuring of <strong>governance mechanisms and land transfers<\/strong> before the proposed democratic arrangement is firmly established.<\/li>\n<li><strong>Relief after 2025 violence:<\/strong> The groups have sought <strong>compensation for victims and withdrawal of criminal cases against 80 protesters<\/strong> connected with the September 24, 2025 violence.<\/li>\n<li><strong>Timeline for legislation:<\/strong> Ladakh representatives want legislation passed during the <strong>Winter Session<\/strong>, while further talks and discussion of a draft Article are expected in October.<\/li>\n<\/ol>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Article 371(K) could provide Ladakh with a <strong>distinct constitutional framework and greater democratic control<\/strong> over key local matters.
